hi i was involved in a accident no fault of mine.the opp party on a freeway decides to make a u turn and comes into my lane i tried to avoid but hit him on his right side.i dont hav insurance and my car is a write off.the opp party has insurance and says i should claim via third party coz it was not my fault.two months goes by and today i recieve a email that they wil not pay me or fix my bakkie.i am considering getting legal council to fight this because i know was not at fault.u cannot make a u turn on a freeway people.

I have referred the matter to our legal department and unfortunately the calculation below is correct.
A driver is entitled to assume that other road users will act reasonably unless there is some circumstance, which warns or ought to serve as a warning to him, that the other road users may act unreasonably. This does not relieve a driver from his duty to be vigilant so as to be in a position to take steps to avoid a collision should the driver of the other vehicle act unreasonably.
In light of the above and the position of the impact on both vehicles, we tender a settlement of ……70/30 %
apportionment in your favour.
Settlement calculation: 6Our damage = R34029.00 repairs to truck + R42775.00 repairs to crane = R76804.00 X 30% = R23041.20.
Your damages R34700.00 market value – 40% salvage value = R20820.00 X 70% = R14574.00...
Our Nett offer = minus R8467.20.
Based on the above calculation, you will owe an amount of R8467.20 to Old Mutual Insure.
In order to settle this matter amicably, we suggest that each party bears their own cost./
