Not paying 3rd party claim

Dear Old Mutual Insure. Your service of third party claims is appalling. Your client drove into my wife on 26 July this year. On 28 August we submitted all the necessary quotations and documentation. After numerous telephone calls and emails from ourselves and the insured’s brokers we were informed that the claim had been passed on to your Cape Town department. After more emails and telephone calls we eventually received notification on 4 October that the claim had been passed on to a liability negotiator. After more emails we eventually received a letter on 27 October stating that each party should bear own costs. The letter was factually incorrect and a transparent attempt to avoid paying out based on The Apportionment of Damages Act. After due consideration we prepared a response and emailed it to your negotiator on 15 November. We have had no acknowledgement of receipt or other reply to this letter so far.

Given this level of service why should anyone purchase third party cover from you?

Dear Old Mutual Insure. Your response to us is unacceptable. In your letter you openly admit that your client jumped the stop street and collided with our vehicle, but you still have the nerve to invoke the Apportionment of Damages Act. I repeat my question; why should anyone purchase third party cover from you given that you are not going to pay out.
