Niglegence and non accountability by insurance
<p>Message:</p> <p>28/09/2016</p> <p>17:30</p> <p>Vehicle insurance negligence by (Mutual and Federal) vehicle insurance company<br />This correspondence serves to furnish broad and detailed report of what transpired</p> <p>The correspondence is of Benjamin Malgas in Kopanocomplex, St Helena Welkom Free State.</p> <p> I am a client of Mutual and federal close to ± 3 years since I bought a vehicle in on 31st /07/2013 with Manhattans dealership in Welkom (Free State).Financed by MFC Ned bank division.</p> <p>I then decided to join Mutual and Federal groups and took out short term insurance ascomprehensive insurance company through the broker company called KR solutions that is also in situated in Welkom. I have since been a member with this insurance since then without any problems until December 2015 when I got involved in a minor accident whereby I tried avoiding collusion with the taxi that was driving in front of me and bumped my front right wheel to the pavement , The same day I contacted the insurance for claim and the my car was taken to Andree and Pienaar panel beaters still in Welkom ,I went through the necessary claiming steps including reporting to nearest Police station ,I was later that day provided with courtesy car to use from Avis though my brokers arrangements and paid by insurance for a month during December period as the car was supposed to be repaired and most panel beaters were closed for December holidays </p> <p>On 05 January 2016 I received the email from my broker that my vehicle was deemed written off and the person that was working on my claim was Miss Yandiswa Masumba from Mutual and federal Head office in Johannesburg, Later that week I received also the checklist from Insurance through my broker stating process of paying or settling the bank . I tried several times to make the insurance aware that my car could not have been deemed a write off reasons being as follows.</p> <p>a) There was no engine leaks</p> <p>b) Air bag never popped out</p> <p>c) The only affected part of the car was a right front wheel</p> <p>d) I demanded the accident report and assent report from the assessor and until today insurance has never provided me with</p> <p>Following this Effort that I took all was ignored and I was told that the assessor has deemed car as a write off and the MFC bank would be settled by the insurance for the amount of R131.000. Then I was also supposed to hand the Avis care back as the time that it was booked for me was over stood firm with emphasizing the concerns I had about the entire car issue that I even drove to Bloemfontein mutual and Federal office for clarity in conjunction with these case. I was then referred back to Johannesburg to raise my concerns but all that was rejected by Yandiswa from Mutual and federal claims department, I involved my broker and it also came to surprise that the vehicle is off the road. On the 28 January I went to my broker to find out where the car was because I left some of my staff in it when it was towed after the accident and when she called the insurance in Johannesburg to find out she was told that it’s been sent to Rooderport for Auctioning and that raised curiosity and wonders because if that was the case there already some discrepancies in that entire process.</p> <p> </p> <p> </p> <p>Reasons being</p> <p>a) No one from the insurance wanted to hear my side story rather Insurance was so quick to pay the bank settlement within days</p> <p>b) The insurance took the car to auction and funny the other set of keys was still with me and insurance neither broker never demanded them</p> <p> </p> <p>After analysing this whole situation and finding all this gaps in this car issue I then decided to take leave from work and follow the story up by myself and investigate self</p> <p>On the 9th February 2016 I personally went to were the car was taken after the accident and shocking on my arrival the car was there and I was told that the insurance never came back panel beater to confirm repair or to claim it of which that made me more inquisitive. They also told me that that car cannot be a write off and furthermore the assessor was never there to assess my vehicle Iimmediate contacted my broker and we were all confused and shuttered about the matter. I took the pictures of the vehicle and requested the copy of quotation .the quotation for repairs amounted to amount of R32 107.27 as opposed the huge amount that insurance already paid to the bank of R 131000 rather than paying 32000 to repaired the car then that’s is when the whole story unfolded that either ***** or negligence by mutual and federal office</p> <p>During all this processes of getting this I had to rely on taxi for every move that I made that required transport as a mode I Had to travel from home to Welkom either by lifts or taxi /</p> <p>Later on the day of the 09th February I then approached Mutual and federal in Welkom personallyto demand a written assessor’s report of the vehicle implicated to my surprise this were findings</p> <p> There was never an assessor that came to assess the vehicle</p> <p>The vehicle that was written off was a green Megane not silver as mine is silver as they compared the pictures I have on my phone and the pictures of the car that was written off</p> <p>The two vehicles were total different models and makes</p> <p> </p> <p>Then when insurance realised the scandal they immediately apologised and confirmed they will investigate .it then hired a car from Avis that I was told to use till my car war repaired because the panel beater was to wait for the parts from abroad, I used that vehicle from Avis for March, April and May I communicated with both my broker in Welkom and the insurance in Johannesburg to find out how far was repairs of the car. (Emails Attached) I was also informed that the car would be re reregistered to back my name and Banking and instalments transaction would be reversed for me to continue normally with payment once the car was released. I then paid the access amount after the repair and the insurance paid the rest of R32 000 for the repairs to the Panel Beater .In May I had to fight once more for clarity of re registration process an later that month a gentlemen from Johannesburg was send to reregister the car with SAPS and Traffic department .I went with him to Welkom SAPS vehicles department to feel in the request for police clearance for and take it to traffic department. (Emailsattached)</p> <p>In June when I asked if the process is complete I was told that the bank is delaying to reverse the amount back to insurance and that would be done soon that month.</p> <p>When I went to check at SAPs and Traffic department the vehicle was never reregistered at all and appears write-off on SAPS systems .I called Mutual again and I was told the story about the bank delay.in July I went and checked the with Traffic department and story was still the same</p> <p>In August I was told that since I’m on process of trade I should identify the dealership to take the vehicle and il would be given the amount t of R60 00 to deposit the new vehicle then mutual and federal would take the vehicle in dispute from there I would the new car. I spoke to one of the managers named Leon Osthuiysen from mutual and federal head office on Friday the 24th September 2016 who then said they are aware and apologise for the delay but Tuesday the 20the September 2016 all would be processed as settlement of the matter. Already the Linsay seaker Welkom was prepared with the quote of R60000 and still is .On Wednesday 28th I got a call with different story from some else working at head office of mutual and federal that they cannot do anything.</p> <p>Every time I call the office daily I get someone else, the only person who has been consistent is Miss Jeannete Mongae from mutual and Federal since the beginning of this drama. She is the one who is also coming with amicable solution.</p> <p>My recommendations are it is either insurance bring the car back to my name and reverse the banking processes because I bought the car with the Bank not insurance, whatever the processes are insurance would have to take the responsibility to ensure that my car is back on my name cause they are the ones who messed up .either they continue with the depositing of the new vehicle then I proceed to pay new car and they take the megane. If they don’t have any solution then let the deregistration do the process and I continue to pay the bank as usual an per agreement of the contract I had with the bank</p> <p>a) As we speak the Car is on insurance name as a write off but it it’s physically with me since the repairs</p> <p>b) The disk of the car has expired and I can’t renew it because it was never reregistered with Police or cleared</p> <p>c) I still pay the insurance premium of 1200 monthly since January 2016 when the claimed the car to be write off and insurance still takes it though I don’t have a car</p> <p>d) The insurance has never committed to solve the problem unless I call them for follow up</p> <p>e) The premium still deduct for nonexistence car of Authorities</p> <p>There for as a result I have no mode of transport at all because it is ******* to drive a car that does not have a disk</p> <p><br /> </p> <p> </p> <p> </p> <p> </p> <p>My concerns about the hide and seek of the insurance is:</p> <p>Who assessed the car?</p> <p>When and where?</p> <p>Why was the car written off?</p> <p>Why did the insurance hire the cars from Avis for almost four months there is nothing wrong they did for me to use?</p> <p>Why did they pay panel beaters for repairs if they were sure and promised to re intate the car back in my name</p> <p>Who is to be held responsible as the insurance management gets *****?
