M&F refuse to pay out what I am owed. I am the 3rd party.
<p>I am the 3rd party in this accident and I have to deal with terrable service, very slow, rude and non complient. This is my experiance with Mutual & Federal.</p> <p> </p> <p>On 30 December 2016 a guy crashed into my car by pulling into the road from a lay-by putting their car directly in front of mine with no warning and absolutely no time for me to stop my car. We both agreed that he was at fault as there was no way I could have avoided the collision due to his actions even though I was driving defensively and under the speed limit.</p> <p><br />He is insured with Mutual & Federal. After going through all the correct procedures and having very slow progress with M&F they have come back to me saying that I am partly to blame for the accident and they refuse to pay me out the proper amount.</p> <p><br />The market value for my car is R42200.00, they have offered me R7781.70</p> <p><br />Not only is this an insult but they have imp**** that I do not drive defensively! One of their insured crashed into my car it was their fault and now their insurance company refuse to pay me out.</p> <p><br />I have evidence including a written statement by the insured stating that the accident was not my fault yet M&F will not pay out. Please can someone help.</p> <p><br />I am in communication with the guy who crashed into me. We both agree on how things took place and that M&F is being very difficult.</p> <p> </p>

Thank you for your letter dated the 24th April 2017. We have investigated your complaint and regret that we are unable to review the settlement offered for the damages incurred on your vehicle.
The reason for this is that it is the duty of the driver following another vehicle to keep a proper lookout and avoid colliding into the rear of the vehicle being followed. It is our view that the sole cause of the loss is your negligence in that you failed to keep a proper lookout and collided into the rear of our client's vehicle.
In light of the above, please note that the complaint has been subsequently closed.

First of all I was not following anyone! The other driver was stationary in a lay-by on the side of the road! As I was passing him he pulled across the road to do a U-turn! I was not following anyone! When he started to move and pull into the road I saw him as clear as daylight, but it was too late to avoid a collision! Second of all, he did not indicat or show any sign that he was going to start moving! Thirdly, I have been told that "the sole cause of the loss is your negligence." Really!!! This what you can expect from Mutual & Federal when making a legitimate claim.
So now, Mutual & Federal has finally come back to me and this is their response:

Please note that the version provided by our client is that he was turning into filling station when he heard screeching tyres and then a collision. Your version differs to this but even as per your version, it would not warrant a 100% settlement as there is still contributory negligence on your part.
We regret that we cannot be of further assistance.
