Failure to fullfill their contractual obligation

I was insured with Mutual and Federal and I was involved in an accident and first quotation was to fix the car for R92 939.04 and later there was second quotation of R146 000, then insurance decide to write it off, I was not given any options available to me when the car is been written off, I took initiative and approach the insurance and informed them that I want to retain my car and repair it myself, this was agreed by the insurance, and I send them the documents that they requested to do settlement then later they informed me that they wont settle since my car is still owing to the bank, they are only going to settle after receiving the settlement letter to the bank. Insurance advised me to go and remove my car from the penal beater, on my arrival from penal beater, I found that they ***** a battery and wires were cut off, when ask about this, because the accident happen in front and the battery is in the back, there was no answer or any explanation for this, I was just informed that the owner is not available and he will call me on his return and explain. to date there is no call from the owner or insurance, someone was trying to inflate the price for repairs.
