Do 3rd party claim ever pay out?

So after Old Mutual's insurer was at fault for an accident that she caused by not focusing on the road, Old Mutual decided not to pay out because according to them she was not liable. This after my statement was not even taken into account.

That is not even the worst. My accident happened on 28 August 2018 and was concluded late last week. More than 3 months after the claim was done.

The people who worked on the claim had no idea what was going on, I was **** to more than once when told that I would be contacted. Once I phoned and was told they were waiting for documentation from 4 August 2018, after I tried to tell them that that would not be possible. When I phoned that same day again, they told me the case was closed and when I phoned the following morning they told me they had just appointed an assessor. Absolute shocking service.

Now I am wondering if they ever pay out 3rd party claims if they don't take into account the victims statement?

I requested the assessors report and the insurers statement last week and I have not even had a response since then.

Still awaiting a response from Old Mutual's complaints department too.

I will forever and always advise anyone who wants to listen to not go to old mutual because they really do not care.
