Misrepresentation by Benita

My name is Rene. I intended to rent a unit at Cherry Blossom Estate, Loulardia, Centurion in December 2024 with the M-T agent Benita. Her voice note: "Hi, weet jy Rene, daar was baie mense wat gekla het die afgelope tyd oor miere en vis motte. Nou ongelukkig werk dit nou so. Body Corporate doen niks daaromtrent nie en uhm, eienaars en huurders moet nou maar self daarna kyk ......... en ek weet ook, ouens het gekla van vis motte, so ja, as jy gedoen het, is dit great hoor". Her response after my shock voice note of multiple dead fish moths found in the unit after I have put in multiple doom foggers. The agent was aware of the insect infestation in the complex. This was never disclosed to me before signing the lease agreement. This express misrepresentation, induced me to enter into the agreement. I would have never entered into an agreement if I knew of this infestation. I got Pest Control Specialists out and they confirmed Cherry Blossom is a problem this was the 2nd time this year already they have been out. Bottom line: I never moved in and they are keeping 2 months rental over R20 thousand rand. "Our client suffered damages as a result of your clients failure to honour her contractual obligations. Our client has yet to find a new tenant and as a result, has in fact suffered more in damages than the one month penalty charged in accordance with the lease agreement" Their lawyer response. Asb jy moet vir my by more oggend se of jy die eenheid neem sodat ek die res op My waglys kan ****ak". After this kind of daily response from new tenants why is this unit still empty? Speaking to various people in the complex they all confirmed they know about this problem for a long time, nothing new!!!
