Deposit not paid

January my electricity was cut off out of the blue, I did a follow up with Michelle she told me I have not been paying the full amount, which was an honest mistake from myside. From her side she was not sending me invoices, she didn’t even communicate with me. When I asked her to reconnect me she was rude and she even got to a point of saying “what are you going to do” I reported the matter to the RHT where she was instructed to reconnect me. I served her with my notice to terminate the contract because I had tolerated the place with its issues, the bathroom was forever flooding due to the sink that was licking and I had reported it since the day I occupied the flat, my car was stained sever times by the leaks in the parking lot.

After I had served my notice there was an attempt to break into my flat, with a key that is identical to mine. The key broke in the key way and I reported the matter. There was no response.

I evacuated the unit, an exit inspection was conducted and all was in order. I requested for my deposit back.

Michelle told me that, it is equivalent to the penalty fee. I had requested a statement that clearly indicates that my deposit was in a trust account and accumulating interest. I have never received it. This is my right according to the act.

Secondly she had failed to provide reasons as to why my deposit was not paid.

There is a tenant that has occupied the unit meaning there has not been any loss due to the early termination and early termination is my right when the unit is not to the standard it is supposed to be
