Under debit Review

Good Day... My experience was extremely terrible, which left me under debit review due to false information provided as well as approaching my creditors under false pretence.

Dear Mosa

We listened to the recorded voice mandate and we could not find anywhere in the recording that suggests that you were provided with false information. You actually consented that we can proceed with your debt review application.

The DC have suspended it's services for non-compliance. You never paid the DC fees and legal fees for us to proceed with the application.

I didn't sign any document for my consent, so how do you still put me under debit review? What consent was given to you for you to proceed with putting me under debit review?? Which channel was utilized? How do you approach my creditors without my consent, I request you remove me from this debit review before I take tis matter further!!

The application was done online and the 2 telephonic conversations you had with the call center agent and confirmations agent respectively are recorded and stands as the voice mandates, which are acceptable as your consent especially the confirmations call because that is where you were asked whether we should proceed with the debt review application. You had the chance to say No, we should not proceed but you opted to give consent. However,  we will forward your cancellation request to the cancellations department but read the withdrawal process below as per the GUIDELINES OF THE NCR:

Kindly note the NCR Debt Help System(DHS)shows that you were declared over-indebted therefore, if you want to be taken off debt review, kindly note in terms of the debt review withdrawal guidelines a consumer can only be removed on debt review in the following instances; 

•    A consumer has withdrawn from debt review prior the issuance of FORM 17.2 (before being declared over-indebted) 

•    When a consumer has settled all debt obligations and a clearance certificate has been issued (Section 71(2)(b)(i)) of the NCA no. 34 of 2005.

•    When there is a granted debt review court order and such an order has been rescinded, consumer to approach a Debt Counselor to issue a 17.W. 

•     If a consumer has been declared over-indebted and no debt review Court Order has been obtained, a consumer may approach an Attorney to assist with an application to the Magistrate’s Court, to be declared no longer over-indebted 

•    If a consumer is not satisfied with the services of a Debt Counselor, he/she may transfer to another Debt Counselor. 

 Therefore, you need to settle all the re-arrangement debts in full or approach a court & apply for a declaration order which declares that you are no longer over-indebted 

   However, we will forward your request to attorneys who will call you shortly should you not have your own.
