Frustrated by MSA Consultants

Good day,

A while ago i lost my identity document. Reported it to the nearest police station. Later, I was handed over to debt review consultants because apparently I was failing to pay for a supposed loan taken from African bank, of which I knew/know nothing about. Seems to me someone was using my ID to obtain such loans. I then consulted MSA Consultants , they requested i send them an affidavit, proof of address, and ID copy. They gave me a turn around time of about 21 days since February. And the promised me a letter of clearance for my issue, unto this day I haven't received the Clearance Letter as they had promised. I am frustrated and I need to build my house, yet I cannot do anything with my life at this point.

Kindly assist me as a frustrated individual.

We have a telephonic recording in our possession where you confirmed with our agent, Nadine, that you have the 3 African Bank loan accounts. We can send you the recording on request. It is clear on the recording that you knew what you were getting into and that you indeed obtained such loans at African Bank. We have checked with African bank and they confirmed that you still have outstanding balances. Therefore, we cannot withdraw you from debt review. You have to pay off all your accounts before you can be withdrawn. Alternatively, you can approach any magistrate court with jurisdiction to declare you no longer over-indebted. Kindly read the following NCR withdrawal guideline:                                                         If client requests to be cancelled from debt review

 Kindly note the Debt Help System shows that you were declared over-indebted therefore, if you want to be taken off debt review, kindly note in terms of the debt review withdrawal guidelines a consumer, can only be removed on debt review in the following instances; 

 •    A consumer has withdrawn from debt review prior the issuance of 17.2 (before being declared over-indebted) 

•    When a consumer has settled all debt obligations and a clearance certificate has been issued (Section 71(2)(b)(i)) of the NCA 

•    When there is a granted debt review court order and such an order has been rescinded, consumer to approach a Debt Counsellor to issue a 17.W. 

•     If a consumer has been declared over-indebted and no debt review Court Order has been obtained, a consumer may approach an Attorney to assist with an application to the Magistrate’s Court, to be declared no longer over-indebted 

•    If a consumer is not satisfied with the services of a Debt Counsellor, he/she may transfer to another Debt Counsellor. 

 Therefore, you need to settle all the re-arrangement debts in full or approach a court & apply for a declaration order which declares that you are no longer over-indebted 

 However, we will forward your request to attorneys who will call you shortly should you not have your own.
