A Living Nightmare

I was contacted by a consultant from MSA consultants who offered to reduce my monthly repayments of my accounts and I provided him with all my information. I was not in arrears or in any financial stress at that time but I was curios to explore a reduced monthly repayment. he also advised me that this would in no way affect my credit profile.

His supervisor then called me about 2 hours later and confirmed my details, she was supposed to send me documents to complete and send back to her, I informed her that I was not sure that I wanted to use their services but she basically forced me. I did not receive any documents from her and advised her that I could not access any documents. she promised to resend them but I did not receive them.

two days later she called to ask me about the documents and I told her that I do not want to use their services at all. she informed me that I would need to pay a cancellation fee even though they did not get any signed documents from me.

Afew days later I went to use my Game Store card and was advised that I could not as I was under debt review.

I am now furious as this is not what I wanted. I will take this matter to the highest level should my matter not be resolved immediately. I want MSA to remove the debt review status from all my accounts and provide me with a letter stating that I am not under debt review.

I have sent various emails to them and tried to phone them on numerous occassions but I have no response to my emails and they never anser their telephones.

Definition of a Complaint

A complaint means, a specific complaint relating to the Debt Counselling service rendered by a DCASA registered Debt Counsellor or its representative to the complainant on or after the commencement of the debt review process, and in which it is alleged that the Debt Counsellor or its representative:-Has contravened or failed to comply with the provisions of the National Credit Act;
Has willfully or negligently rendered a Debt Counselling service to the complainant; or
Has treated the complainant unfairly.

Complaints Procedure

The Complaints Procedure documented below addresses the duties and functions of all parties involved in resolving complaints under the following sections:

The role players in the complaints process.
DCASA’s complaints process.

1. The role players in the complaints process.

The main role players in the Complaints Resolution Process are listed below:

Role Player
Description
Complainant
This is a person who has suffered prejudice by a Debt Counsellor or Representative and has decided to lodge a written complaint against that Debt Counsellor or Representative.
Respondent
The Debt Counsellor or Representative against whom the complaint is made.

2. DCASA’s complaints process.

The process of handling a complaint needs to conform to DCASA’s stated policy. Any such deviation from policy requires the sanction of the Secretary of DCASA.

DCASA will be responsible for the registration and monitoring of any complaint and for referring such complaint to the Debt Counsellor.

The complaints process will in the majority of cases consist of two steps which need to be followed and adhered to by all Debt Counsellors and/or Representatives.

The Complaints Resolution process for DCASA is as follows:

Step1:

The majority of clients will contact DCASA telephonically to register a complaint and the following process must be followed:
Client must be requested to lodge complaint in writing and to provide supporting documentation;
Registers complaint (Name and Id number of client);
Establishes the name of Debt Counsellor and if the Debt Counsellor is a member of DCASA;
Informs Debt Counsellor of pending complaint.
Step 2:

This step deals with a formal complaint being received from a client and should be dealt with as follows:
Checks complaint and supporting documentation;
Identifies Debt Counsellor;
Records complaint in Register;
Submits complaint to Debt Counsellor;
Diarises for 12 business days; and
Debt Counsellor acknowledges receipt of complaint in writing to client within 2 business days of receipt.
Debt Counsellor to review complaint and then provides the client with a written reply and a copy is submitted to DCASA within 10 business days.

Dear MSA Consultants

your response dated 20th May 2017 that you will ensure that someone from the cancellations department would call me has ALSO not been done to date. Instead some called me to ask me when the signed documents can be expected.

This shows MSA's total disregard for people as well as the history of NOT KEEPING TO YOUR WORD.

This matter has been handed over to National Credit Regulator whom I'm sure will be in touch with your company very soon.
