Unreasonable warranty dispute

Motor Warranty Claim Rejected – Request for Proper Technical Assessment

I am extremely disappointed with the manner in which my motor warranty claim has been handled by MVIA/Motor VAPS.

I am posting this complaint because, despite attempting to resolve the matter directly through the appropriate complaints process, I remain concerned that my claim has not been assessed on the complete mechanical evidence.

The main reason given for rejecting my claim relates to the vehicle allegedly being serviced outside the required service period. However, the service was only 18 days beyond the stated service date.

I have requested that MVIA clarify whether the applicable 30-day/1,000 km tolerance applies to my warranty and, if it does not, provide the exact policy wording explaining why it does not apply.

There is also important mechanical history that I believe must be considered.

Before the eventual failure, I had already experienced cooling-system problems and reported these to Toyota, where I purchased the vehicle. Toyota replaced the water pump. The vehicle subsequently returned to Toyota because of another coolant/leak-related problem. I was eventually instructed by Toyota to make use of my motor warranty.

I therefore dispute any suggestion that I simply ignored or neglected an obvious cooling-system problem.

The workshop subsequently identified the following sequence:

Water-housing failure → coolant loss → overheating → head-gasket damage.

Most importantly, the mechanic's quotation submitted with the claim also specifically includes replacement of the oil cooler. The oil cooler was identified as leaking/failing and its replacement forms part of the actual repair quotation.

This is a significant point because the rejection correspondence has focused on the water housing and head gasket but has not adequately addressed the oil cooler failure or why its replacement is included in the quotation.

I have therefore asked MVIA to provide the technical evidence establishing:

why the water housing failed; why the oil cooler failed; whether the oil cooler was actually considered in the claim assessment; why the oil cooler replacement has not been properly addressed in the rejection; how the alleged service issue caused or contributed to each component failure; and what evidence supports any allegation of negligence on my part.

MVIA's own response also stated:

"While routine service items would not necessarily have prevented the water housing failure..."

I believe this raises an important question: if routine servicing would not necessarily have prevented the water-housing failure, what technical evidence establishes that the service interval caused or materially contributed to that failure?

I am not asking MVIA to pay the claim simply because I disagree with their decision.

I am asking for the claim to be assessed on the actual mechanical evidence, the complete repair quotation, the vehicle's history and the applicable warranty terms.

My requested outcome is straightforward:

I want MVIA to reconsider the claim in full and provide a properly substantiated technical and contractual explanation for its decision, including specific consideration of the oil cooler replacement contained in the mechanic's quotation.

I have now escalated the matter through the appropriate complaints/ombud process and will provide the relevant supporting documentation, including the mechanic's quotation and correspondence.

I am posting this review to place my experience on the public record and to give MVIA an opportunity to properly address the outstanding issues.

I remain willing to resolve this matter professionally and would welcome a substantive response addressing the technical questions above rather than a general restatement of the service-date rejection.

I was contacted yesterday by a Senior Agent who advised that they would re-evaluate our quotation and provide feedback on what would be covered and what would not. I was asked to hold the line.

I remained on hold for approximately 5-10 minutes until my phone battery died. Please note that this call was recorded on my side.

I did not receive any feedback for an entire day, so I followed up with them today.

I spoke to a different consultant who then imp**** that the conversation from the previous day never took place and confirmed that the claim remains rejected.

This level of inconsistency and lack of follow-through is unacceptable.

I have a 2 YEAR MECHANICAL WARRANTY, yet they don't cover an oil cooler yet its a MECHANICAL component?
