Blunt Breaches of Contract when Claims are raised.
These guys draft a Policy document & when you try to make any claim, they'll bluntly disregard what is on their own Policy document. I have been living under an illusion that I was covered for mechanical faults on my car. When i had a clutch failure, they just bluntly told me "WE DO NOT COVER CLUTCH KITS" I speak to one of their underwriters and he tells me that this is stipulated on their "LATEST POLICY DOCUMENT" . As to why they never informed me they have an "Updated Policy document", I have no Idea.
On the policy document i have it says "If i have not made a valid claim and i decide to cancel the policy, they will refund the premiums minus administrative costs" When I then tried to go this route, they Just bluntly told me "We do not do refunds". I say, But this is contrary to your policy document. I am told, "we do not do refunds If you want to cancel, we can do it with immediate effect, but we do not give any refunds. send a complain to our complaints department". JUST LIKE THAT. So here I am, hoping the complaints department will get in touch with me. My obligation is to pay every month as contractually set, which I have done without fail since I took the policy. Your obligation is to respect the Policy you have issued to me.
No. 68 of 2008: Consumer Protection Act, 2008. Section 22 - Right to information in plain and understandable language has been undermined as I was not presented in writing to changes on my policy nor was I informed in any way. Section 48 - Right to fair, just and reasonable terms and conditions. Specifically, Section 48 (2)(c) - "the consumer re**** upon a false, misleading or deceptive representation, as contemplated in section 41 or a statement of opinion provided by or on behalf of the supplier, to the detriment of the consumer;" Section 49 - Notice required for certain terms and conditions Section 51 - Prohibited transactions, agreements, terms or conditions "Variations of the terms and conditions of micro-insurance policies are prohibited unless the insurer can demonstrate that reasonable actuarial grounds exist to justify the variation or change and that the variation will benefit the policyholder or member concerned;"
