Dear Sir,
Motorite has reviewed your complaint and duly noted your comments – we wish to address your complaint as follows:
The product that forms the basis of this complaint is an Options Formula 1 mechanical breakdown warranty underwritten by Infiniti Insurance Ltd. of which Motorite Administrators (Pty) Ltd. act as the appointed claims administrator. The policy provides cover for the failure of specified mechanical and electrical components subject to the policy terms and conditions being adhered to whereby the applicable limits of liability apply. The policy incepted on the 29/11/2017 at 202 115 km and runs for a period of 1 year.
The sale of this product was facilitated through a mandated intermediary whereby Motorite was not present at point of sale and therefore regrettably cannot validate any sales discussions held at that point. We have noted that as per the signed copy of the policy and the record of advice, it would appear that the relevant policy terms and conditions were duly issued to you at point of sale.
The claim in contention was logged with Motorite on the 23/03/2018 at 208 261 km. The repairer had reported that the vehicle’s emission light was on. The normal claims procedure was followed whereby we requested the vehicles service record, written failure report and quotation.
It is important to note that as per the manufacturers specifications, your vehicle has a standard service interval of every 15 000 km or 12 months whichever occurs first with the applicable service leeway’s being 1 500 km or 30 days either side of the service parameter reached first, that being time or kilometres. Servicing and maintenance of your vehicle in line with the manufacturers specifications is of vital importance, to firstly, keep your policy valid and secondly to ensure the longevity of the vehicles mechanical components and the reasonable maintenance of the vehicle.
Our records indicate that upon receiving your vehicles service record we established that your vehicle was last serviced on the 11/05/2016 at 179 154 km, it is noted that the vehicle is currently late for a service by 286 days and 12 607 km over and above the service leeway’s allowed. Due to the late service, which is in breach of policy terms and conditions - Motorite proceeded to suspend the policy for 90 days from the date of the next service still to be done.
The policy wording refers:
3 Your duties
Failure to comply with these conditions will invalidate the cover and therefore any claims made by you will be rejected:
b) Service parameters - Petrol and diesel engine vehicles must be serviced and maintained according to the Manufacturer's specifications and recommended intervals. Where this is not known, contact us. If this is not done, your claim will not be valid and your claim will be rejected, even if the failed part is not a routinely maintained part;
h) Reinstatement - A Warranty that has been invalidated due to improper servicing may be reinstated by having the vehicle serviced at your cost in accordance with the Manufacturer's specifications and the procedures set out. This reinstatement is subject to our prior written approval and will only be effected after a waiting period of 90 days is imposed, as calculated from the date of receipt by us of written notification of your request for reinstatement. This reinstatement clause is not available to vehicles that qualify for the “unlimited” benefit, or vehicles that have been modified. For all other vehicles that fall under benefit 2, 3 or 4 (if applicable) the following components will not be covered under the specified 90 day waiting period; l
a. Engine
b. Differential
c. Gearbox
d. Turbo
e. Drive Shafts
Upon receiving the requested information – Motorite proceeded to further review the merits of this claim and discussed it with senior claims management who have app**** reasonability and fairness to the matter, they have agreed to assist with the claim for the swirl flap motor as a gesture of goodwill, up to the maximum limits of liability allowed by the policy under the respective benefit category, that being the Induction System benefit for an amount of R 2 500.00 including VAT.
Motorite are under obligation to administer all claims in accordance with the policy term and conditions as set out by the insurer.
In view of the matter - Motorite remains of the opinion that your claim was administered correctly, in line with the policy terms and conditions. Should you not be satisfied with the outcome herein, you are at liberty to seek further recourse that is available to you.
Kind Regards
