Wesbank warranty / Motorite

I bought a vw polo 1.2 tsi at McDulling motors Vw Master cars and the delivery date was 1 March 2018. The car had +/- 2500 kilometres on the clock and it came with the balance of service plan and factory warranty till 45000 km or 3 years. I asked the sales person what to do if I want to extend the warranty and he told me that I can talk to him before my warranty expires.

He told me i will receive calls from vw and Wesbank to rate the service i received. I received calls from different people congratulating me on my new car and one call was from a lady who said is from Volkswagen, she also congratulated me on my new car that I just purchased. She then offered me the extended warranty as well as motor plan to 90000 km or 5 years which ever comes first. She told me that the cover on my car does not cover for brake pads, wipers but only covers the service. She further told me that they will cover for the major service of 90000 km of a camber. I asked her with a little knowledge I have that isn't a cambelt supposed to be changed at 12000km and she said no they change it at 90000km. I then believed her since she's working with cars and more especially coming from vw. She further told me that the premium will be combined with the instalment of the car and I agreed to take the warranty.

After some few months, I received the warranty via email and it's only when I realised that the cover was from Motorite. I went to Duttons motors who is a vw dealership to ask about a 90000km cambelt service and they told me that they do cambelt service at 120000km as per manufacture specifications.

I then decide to cancel the cover since they have not deducted any premium and also I have not used their services. I called their call centre to cancel the policy but I was told to pay R15000 cancellation fee which I thought was unfair to me since I was misled where the cover was coming from and also the cambelt service that they said it's done at 90000km which I found was incorrect. Below is the email I got from the consultant after I phoned to cancell.

Thank you kindly for the cancellation requested.

Furthermore, if you terminate this Contract before you reach the contract months or contract expiry kilometers, you may not claim for the remaining maintenance / services due under this contract but a refund may be applicable.

Kindly see attached cancellation form and requirements, please complete and forward back with the supporting documents as listed below.

Please include the following requirements for Control and Client Verification purposes:

• Proof of Residence

• Copy of I.D or Driver’s License

The refund amount upon cancellation will be as follows:

QUOTE ON REFUND AMOUNT R15275.39 INCL. VAT QUOTE VALID UNTIL 16/05/2018, SHOULD ANY CLAIMS OCCUR QUOTE AMOUNT WILL BE NULL AND VOID.

In the event of the Contract being cancelled by the policyholder, commissions and costs are deducted from the premium leaving a balance, which is paid out on a pro-rata basis dependent on the unexpired period of the Contract. The above-mentioned payment is subject to the Terms and Conditions of the Contract having been comp**** with and no claims having been paid out against the Contract. Refunds will be made to the financier of the policy.

Please Note:

The cancellation of your Policy / Contract will void any benefits including coverage of any component/s. Motorite will accept no further liability on any Policy / Contract should you agree to proceed with such. A pro-rata refund amount will be quoted on any Warranty which falls outside of 30 days from point of purchase, a 90 day gratuity period is given on Maintenance & Service plans, please clarify with Motorite as to where the funds will be transferred should any refund amount be paid out.
