Rejection of claim

I bought a vehcile it is a chevrolet utility second hand vehicle i was forced by wesbank to get an extended warranty on the vehicle as the vehicle is second hand when i submitted the claim i just heard from the garage that the claim on my clutch has been rejected and that i will receive feedback and nothing was send to my why and i feel that it is not my fault as the vehicle was mot used alot the vehicle was standing most of the time. In my previous dealings i never had a problem with motorite and i thought this was an amazing company but i was seriously mistaken by this so o will advise any body not to do any business with them.

Dear Sir,

Motorite has reviewed your complaint and duly noted your comments.

The product that forms the basis of this complaint is a WesBank Prestige mechanical breakdown warranty underwritten by Infiniti Insurance Ltd. of which Motorite Administrators (Pty) Ltd. act as the appointed claims administrator. The policy provides cover for the failure of specified mechanical and electrical components subject to the policy terms and conditions being adhered to whereby the applicable limits of liability apply. The policy incepted on the 17/02/2017 at 79 527 km and runs for a period of 2 years. Kindly note that yes, Motorite accepted the policy and risks associated. The sale of this product was facilitated through a mandated intermediary whereby Motorite was not present at point of sale and therefore cannot provide any comment on any sales agreement or discussions held.

The claim in contention was logged with Motorite on the 08/09/2017 at 85 346 km by CMH - East Rand. The repairer reported that vehicle is having difficulty selecting gears and the clutch kit to be faulty. The normal claims procedure was followed whereby we requested the vehicles service record, written failure report and quotation.

Upon receiving the requested information – Motorite proceeded to appoint an assessor to go out an inspect the vehicle to ascertain the cause of failure and confirm the extent of the damage.

The assessment report refers:

“When I arrived at the repairing dealer the vehicle was stripped ready to be assessed. The clutch kit was removed and stripped ready to be inspected. On inspection of the vehicle it was confirmed that bigger size wheels were fitted. The drive shafts are still in good order and none of the boots are damaged. The fly wheel was inspected and confirmed that there is hot spots on the fly wheel indicating that the clutch is overheating. The release bearing is rough on turn. The clutch plate was inspected and confirmed that the clutch plate is worn down unequally on the pressure plate side surface as the outer diameter is thicker than the inner diameter. This indicates that the clutch is not releasing correctly, the friction material is also starting to flake on the clutch plate. The pressure plate was inspected and confirmed that there is no mechanical breakages on the pressure plate. There are also no signs of the pressure plate being collapsed. The friction surface is also discoloured indicating that the normal operating temperature of the clutch was exceeded.

Based on what was assessed it was confirmed that the clutch plate has worn down unequally on the pressure plate side surface as the outer diameter is thicker than the inner diameter and the friction surface is flaking. The fly wheel and the pressure plate friction surface are also discoloured indicating that the operating temperature was exceeded. It can be that the driver is not releasing the clutch pedal after gear change or collapsed pressure plate.”

It is important to note and is worth mentioning that Motorite has in its employment qualified motor vehicle technicians that form part of our claims department and claims management team respectively. Assessment reports supp**** are analysed in detail whereby a final decision is made, based on visuals, technical correctness, experience and factual information.

Upon receipt of the information. Motorite rejected the claim in accordance with the policy terms and conditions for the following reasons:

- Release Bearing

- Flywheel Skimming

- Clutch Plate / Clutch Pressure Plate

- Clutch Cable

Based on the findings - Motorite rejected the claim as bigger size wheels were fitted which is a modification that technically has a direct effect on the transmission of motion from the powertrain to the drivetrain of the vehicle.

The wheel size fitted currently is 205/40/R17.

Manufacturer specified wheels are 185/65/R14 with a larger option of 185/60/R15 maximum.

Regrettably the warranty policy excludes failures of this nature - the contract wording refers:

Paragraph: Items Not Covered By This Policy

We are not liable for:

(d) The failure of, or damage to, any component or part caused by the failure of a covered or non-covered part, includingdamage caused by any object from an external source;

(e) Breakdowns resulting from using the vehicle, whether in the past or present: (vi) Modifications which have not been approved by the vehicle Manufacturer, including, but not limited to all engine conversions and turbo-charged units;

In view of the matter - Motorite remains of the opinion that your claim was administered correctly and in line with the policy terms and conditions.

You say that it is the tyres but when the vehicle went for inspection the bank did not inform me to say the tyres is to big the checked the car and said the deal can go through and that i have to take the extended waranty so then n feel that the tyre does not make a difference because i was suppose to be informed that the tyres is to big and and on the clutch how can you establish that the burn on the clutch is me the car was not driven much and how do you establish it is me i moght have got the car with that and that it just became worse but just like i have veen informed motorite is a company like *****ing peoples money and inriching themselves and you will keep on looking for excuses this is the worst company ever and i will ensure that all people i know does not ever take a plan with motorite and i have reliable source that informed that motorite like rejecting claims worst company ever.

The sale of this product was facilitated through a mandated intermediary whereby Motorite was not present at point of sale and therefore regrettably cannot validate any sales discussions held at that point. We have noted that as per the attached record of advice as well as the signed copy of contract it would appear that the relevant policy terms and conditions were duly issued to you at point of sale.

Important factors to consider as well as the adverse effect or this modification and, or fitment of non-standard tyres and rims would be:

it makes the suspension fully compress and rebound.
gives inaccurate speed readings as to the speed reflecting on the speedometer.
higher fuel consumption.

If the wheel diameter increases, the height of the tyre should decrease accordingly to compensate, in order to keep the overall diameter the same. Using bigger diameter wheels/tyres with stock ratios will cause more wear and tear on clutch, differential, drivetrain, gearbox and engine.

The assessment report refers:

Taking the above into consideration - Motorite remains of the opinion that the claim was rejected correctly in accordance with the policy terms and conditions.

How can you as a company still say the claim has been rejected as i informed you that i did not do any changes i bought the vehicle with those tyres and how can you establish it was my fault on the clutch this is a second hand vehicle not a new vehicle so the burn marks could have been there But if that is the case i would like my money be paid back to me and i want it done with in one day and i will keep on making your company name bad as long as it take you *****ing peoples money. I was never informed when the sale was done on the vehicle that the tures is not the correct size so it remains a fact that you are the worst company ever and just want to ***** a persona money.
