Dear Sir
Motorite has reviewed your complaint and duly noted your comments– we wish to address your complaint as follows:
The product that forms the basis of this complaint is an Options Motor Drive 1 (Plan A) top-up maintenance plan administered by Motorite Administrators (Pty) Ltd. The maintenance plan incepted on the 07/10/2015 at 38 000 km and runs for a period of 2 years and 6 months and up to 90 000 km – the expiry of this plan is dependent on whichever is reached first. This plan was sold to you as a top up on your vehicles built in service plan with the manufacturer.
The sale of this mechanical breakdown warranty was facilitated telephonically through a mandated intermediary. We have noted as per the copy of contract sent via email and upon analysis of the sales call recording, it would appear that the relevant contract terms and conditions were duly issued to you at point of sale.
Our records indicate that a claim was logged with Motorite on the 16/03/2018 at 66 564 km. The repairer reported that the vehicles 75 000km service needed to be carried out. It was advised to the dealer that the Options Motor Drive 1 (Plan A) top-up maintenance plan is a top up on your vehicles built in service plan with the manufacturer, therefore the claim was rejected.
The claim in contention was logged with Motorite on the 19/03/2018 at 66 564km by Reeds Bellville. The repairer reported that the vehicle required repair/replacement of the vehicles left front headlight bulb and the front brake pads and discs. The normal claims procedure was followed whereby we requested the vehicles service record and quotation.
It is important to note that as per the manufacturers specifications, the vehicle has a standard service interval of every 15 000 km or 12 months whichever occurs first with the applicable service leeway’s being 2 000 km or 90 days either side of the service parameter reached first, that being time or kilometres
Our records indicate that upon receiving the vehicles service records we established that the vehicles 75 000 km service was done late, this service was late by 10 157 km over and above the allowed 2 000 km leeway and 344 days over and above the allowed 90 days leeway - which was in contravention of the contract terms and conditions.
Taking the late service into account - Motorite rejected the claim and terminated the contract in accordance with the contract terms and conditions of which refers:
Service History
If the vehicle does not have an up-to-date and fully valid service history with a Franchised Dealership it does not qualify for this plan. It is your duty to verify this before purchasing the plan. If this is not done, the plan will be invalid, and claims against it will be rejected. A copy of service history must be retained, as this may be requested in the event of a claim.
8 Other Requirements and Provisions Affecting Your Duties and Rights
(ii) Failure on your part to comply with any of the duties stated in this clause will invalidate this contract and therefore any claims against it will be rejected;
(vi) You must present the vehicle for servicing and inspection in accordance with the terms of this contract and according to our recommendations and within the intervals of time or distance required by the Manufacturer but in any event no less than annually. We shall allow a vehicle to be serviced at an over-run of up to 1 500km for petrol engine vehicles or 1 000km for diesel engine vehicles or 30 days either side of the Manufacturer or an annual specified service interval, whichever occurs first. This concession also applies where the contract expiry kilometers coincide with a specific service interval, but if the 1 500km or 1 000km exceeds the contract kilometers and the service interval, then no claim will be entertained by us, aside from the standard service itself. Should the Manufacturer over-run exceed our stipulated over-run as stated, we may, at our sole discretion, allow for such an over-run, as stipulated in the Manufacturer's Handbook;
In view of the matter - we remain of the opinion that the claim and the subsequent termination of the plan was facilitated correctly in line with the contract terms and conditions. Should you not be happy with the outcome of this matter - you are at liberty to seek further recourse that is available to you.
Kind Regards
