Reactive poor service - suspended plan.MIA40915

When my agent claimed to do the brakes on my car,motorite suspended my policy,due to the service been late,my next service was 60000km,but it was 4 months overdue from the yearly service,based on that they suspended.

I am not aware of the mandory yearly,and open my service book seen next service was 60000km,it unfair on motorite to suspended.i never ever communicated with them,the car dealer took out my policy,motorite should have given me a courtesy call to inform me of the consequencers,after the yearly service dated passed and not wait for a claim,and then to suspended.This is not fair and i plan to write to Ombudsmann and then open a case with my legal representative

Dear Sir / Madam,
Motorite has reviewed your complaint and noted your comments - we wish to respond as follows:
It is important to note that as per the manufacturers specifications, your vehicle has a standard service interval of every 15 000 km or 12 months whichever occurs first with the applicable service leeway’s being 1 500 km or 30 days either side of the service parameter reached first, that being time or kilometres. Servicing and maintenance of your vehicle in line with the manufacturers specifications is of vital importance, to firstly, keep your policy valid and secondly to ensure the longevity of the vehicles mechanical components and the reasonable maintenance of the vehicle. Our records indicate that upon receiving your vehicles service record we established that your vehicles 60 000 km service was done very late, this service was late by 109 days over and above the allowed 30 day service leeway.
Motorite therefore proceeded to reject your claim in contention, your plan will also be placed under suspension until your vehicles next service is brought back in line with the manufacturers specifications. Irrespective of the late service - Motorite app**** goodwill and proceeded to suspend your plan, however it should be well noted that Motorite were in full right to terminate the said plan in accordance with the applicable terms and conditions which you had agreed to, of which refers:
Clause: 8.2
Para: Vi
8.2 Other Requirements And Provisions Affecting Your Duties And Rights
(vi) You must present the vehicle for servicing and inspection in accordance with the terms of this contract and according to our recommendations and within the intervals of time or distance required by the manufacturer but in any event no less than annually. We shall allow a vehicle to be serviced at an over-run of up to 1 500km for petrol engine vehicles or 1 000km for diesel engine vehicles or 30 days either side of the manufacturer or an annual specified service interval, whichever occurs first. This concession also applies where the contract expiry kilometers coincide with a specific service interval, but if the 1 500km or 1 000km exceeds the contract kilometers and the service interval, then no claim will be entertained by us, aside from the standard service itself. Should the manufacturer over-run exceed our stipulated over-run as stated, we may, at our sole discretion, allow for such an overrun, as stipulated in the manufacturer's handbook.
9 Termination of This Contract
(a) We may terminate this contract by giving you 20 business days written notice if:
(ii) There is any material breach of any material term of this contract;
In view of the matter – we remain of the opinion that the claim was rejected correctly and your contract suspended fairly as you have clearly breached the terms and conditions by servicing his vehicle outside of the manufacturers specifications.

It would have been better,if one of your agents picked up the phone to inform the clint about his annual overdue service,but remember it was still within the service book km which was 60000km.
I hope others read this and cancel their ploicy with motorite a *******.
