Pathetic Service - Being sent from pillar to Post

M have mainatnance with Motorite and on the 30/12/2016, my vehicle would not start from work. I contacted VW as the car was still under warranty and was they sent through a towing truck to take the car to their premises. On arrival it was around 15h30 and I asked the technician to have assess the car to determine if it can be fixed because I had to travel to Limpopo on the same day.

The techniacian advised the head gasket had blown and it will be a massive job to remove the parts to determine what else could have gone wrong with the vehicle. As they were about to close they did not remove all the parts on the day the car was towed, they were closed on the 31/12/2016 and the warranty expired on the 02/01/2017. After removng all the parts and assesing the car fully they then sent the quote to motorite.

I contacted them to follow up and they advised they have been waiting for feedback from Motorite and when they called again to follow up they were advised the person that was handling the case was offsick and they had to resend the documents again.

I then decided to be contacting both the compaines to follow up as I am the one without a car and have to spend extra cash renting cars for work . On the 10/01/2016 I contacted Motorite and the consultant told me thatVW did not follow up with them hence they did not know the person the case was allocated to was now off sick and I must know that we are all human and no one chooses to be sick.

I phoned again on the 12/01/2017 and was told motorite is still waiting for manager's authorisation and that the bill that was sent was too high. Graham requested that I sent him the Tax Note from the towing company as VW should fix the car because it was under warranty when the problem occured and he would use the information to communicate with VW.

I emailed him the note on the 13/01/2017 and by yetserday at 16h30, I had no response and decided to phone Motorite again and was put through to Clive who requested I forwad him the same tax note. He later responded on email that Motorite reject the claim.

I have sent him an email this morning and still no response from him or should I assume he is the one offsick today?

I dont understand why I should pay for the vehicle out of my own pocket while I have maintanance and need clarity on this matter.

Dear Madam,

Motorite has reviewed your complaint and have duly noted your comments.

The claim in contention was only logged with Motorite on the 09/01/2017 at 34 280 km by your preferred repairer Hatfield Volkswagen – Randburg. The repairer reported that your vehicles cylinder head gasket had blown. The normal claims procedure was followed whereby we requested the vehicles service record, written failure report, diagnostics and quotation.

It has been confirmed that your vehicles breakdown occurred on the 30/12/2016, it must also be noted that your vehicles Manufacturer Warranty Expired 06/01/2017.

Upon receiving the requested information – Motorite proceeded to reject the claim for your vehicles cylinder head gasket repair as the failure occurred whilst your vehicle was under the Manufacturer Warranty, this in accordance with the relevant policy terms and conditions in which refers:

Clause 5 (a)
Paragraph (ii)

Any charges normally recoverable under the manufacturer's warranty or, if applicable to the vehicle, manufacturer or other approved service and maintenance plan; or charges where you have any other cover, or partial cover, for the same loss or damage covered by this plan. In such a case we are only liable to repair to an amount equal to the uncovered portion of loss or damage.

To confirm:

· The Manufacturer’s Warranty on your vehicle is 100 000km / 36 Months

· The Manufacturer’s Warranty expired on the 06/01/2014

· Your vehicle broke down on the 30/12/2016

As the failure occurred whilst the vehicle was under the Manufacturer’s Warranty, the claim therefore needs to be referred to the Manufacturer VW for assistance.

I trust that we have now fully clarified the reasons for your claim being rejected, you will too receive a notification letter advising of such.

In view of the matter – we remain of the opinion that the claim was rejected correctly in line with the relevant contract terms and conditions.

Kind Regards,
