Dear Sir,

Motorite has reviewed your complaint and duly noted your comments.

The product that forms the basis of this complaint is a Options Formula Extreme mechanical breakdown warranty underwritten by Infiniti Insurance Ltd of which Motorite act as the appointed claims administrator. The policy provides cover for the failure of specified mechanical and electrical components subject to the policy terms and conditions being adhered to whereby the applicable limits of liability apply.

Our records indicate that Motorite assisted with the cause of failure in this instance, that being the timing chain. The timing chain failure and caused the engine to mistime which resulted in the pistons to impact the valves. The diagnostics which was received from “Audi” shows that there were fault codes registered prior to total engine failure occurring. The first fault code appeared at 134 541km but the vehicle was further driven for an additional 251 km. These fault codes would have alerted the driver of the imminent engine and if the vehicle had been presented on time , the resultant engine damage would have been avoided, limiting the repair to only the replacement of the vehicles engine timing chain. It was for this reason that Motorite only assisted with the cause of failure. Your policy wording clearly refers:

“Take care of the vehicle - you must take all reasonable steps to service the vehicle as detailed below and keep it roadworthy. You must immediately stop using the vehicle if the vehicle breaks down or if a breakdown is imminent;”

In view of the matter - Motorite remains of the opinion that your claim was administered fairly, correctly and in line with the policy terms and conditions.

Regards,

Motorite Administrators (Pty) Ltd
