Motorite Extended Warranty a ****
I have an extended warranty with Motorite. My leaf spring broke in the rear suspension and my claim was rejected because it was not specifically mentioned as a specific item.
The leaf spring is the main component of the rear suspension.
They then cover themselves with a clause stating that if a part is not specifically mentioned as covered, then they do not cover the item. These policies are an absolute ****, in the fine print they could find wording to reject any possible claim.
from the contract: "Suspension / Air Suspension Upper and lower wishbones with associated ball joints and bushes and air suspension pump, compressor and related sensors excluding bellows;"
They mention to exclude the bellows, but not the leaf springs, but then because they didn't mention the leaf springs they are also excluded?
Surely a layperson with no knowledge of cars would expect leaf springs to be covered.
Dear Sir,
This letter serves to confirm that we have reviewed the merits of your complaint received on the 01/08/2018.
The product that forms the basis of this complaint is a LMC Prestige Plus mechanical breakdown warranty underwritten by Infiniti Insurance Limited of which Motorite Administrators (Pty) Ltd. act as the appointed claims administrator. The policy provides cover for the failure of specified mechanical and electrical components subject to the policy terms and conditions being adhered to whereby the applicable limits of liability apply. The policy incepted on the 26/07/2018 at 89 000 km and runs for a period of 2 years.
The claim in contention was logged with Motorite on the 02/08/2018 at 90 032 km by Lazarus Motor Company (Pty) Ltd T/a Ford Centurion. The repairer reported that the vehicle came in with the steering light on and the steering was skew. It was found that the leaf spring was broken and requested replacement thereof. The normal claims procedure was followed whereby we requested the vehicles service record, written failure report, photos and quotation.
Upon receiving the requested information – Motorite proceeded to reject the claim for the leaf spring as this item is not listed as a covered component within the ambit of the warranty policy.
Please note that under components covered you will see a detailed list of the covered components. If a component is not listed, then it is not covered.
Regrettably your policy does not cover every eventuality and hence the need to fully understand what is covered within the ambit of the warranty policy.
After careful consideration of all the factors pertaining to your complaint, we regret to advise that our decision remains unchanged.
Please refer to the following clause(s) in your policy wording:
Clause: 20 - Items Not Covered By This Policy
Paragraph: (a)
In view of the matter - Motorite remains of the opinion that your claim was administered correctly, in line with the policy terms and conditions.
Thank you for your cooperation and patience herein.
Kind Regards,
