Motorite Aministrators vs VW

I took my car in for services a VW in Kempton Park for 90k which was covered by them. The following day at about 9.00am car didn't want to start, had to tow the car to the nearest VW in Benoni. This all happed on the 19-12-15.
Was told by VW that they had to remove the top of the engine because the pistons were bent. I was billed
R 35k to replace all the pistons, chains etc. Then asked them what went wrong, was told the chain snapped.
Called Motorite as I have a motor plans/insurance with them. I told the them whole story as mentioned above.
After a couple of days was told that the car was faulty at 89553 km before the service was due and that they will only cover R9k to replace the chain shaft only. This came up when they asked VW for a diagnostic information of the car.
Motorite claims that VW was at fault because they didn't do a diagnostic check on the car when the car came in for service. VW on the other had say that they need to do a diagnostic check on the car for a 90k service unless a fault light come up on the dash.
Now no one wants to take responsibility and don't know what to do because I don't think its fair for me to pay the 25k from my pocket...I NEED HELP!!!

Hello Mtsheblone31,

Dear Sir ,

The repairer reported that the vehicles cylinder head was removed and the valves are bent and needed to be replaced. Motorite proceeded to appoint an independent assessor to go out an inspect the vehicle to ascertain the cause of failure and confirm the extent of the damage. Motorite proceeded to request for the diagnostic printout from the repairer to establish the technical failure and what exactly occurred, the diagnostic printout received from the repairer indicated that there was a fault on the camshaft position at 89 553 km. The vehicle was then serviced on 89 990 km, unfortunately it would be unfair of Motorite to comment whether this was picked up when the vehicle was taken in, however it is clear on the diagnostic report that this fault was evident. However even if the failure was reported to Motorite at that time, we would have only covered the cause of failure,- in this instance Motorite have authorised the claim for the timing chain as this was determined to be the cause of failure
