Apparent Breach of Contract
I purchased a Chevrolet Optra for my wife in Cape Town in 2011 as well a Motorite Policy. It was for 60 000km /5 years whichever occurs first, we had discussed being low mileage users and agreed this would cover us for the time frame. Until last week we had no problem with Motorite. My wife took the car in for its last service 60 000km/ contract ends 14.2.2016. Later that morning she was contacted by the dealer to advise her that the contract had expired last year when it had been logged for a 60 00km service even though there were less that 47 000km on the clock. She called the Motorite call center to be told that the contract was only for 4 services at 15 000km intervals. After speaking to the dealership and being told to read my contracts fine print and two further calls to Motorite we read our copy of the policy given to us on purchase of the car and could not find any reference to low mileage vehicles or any clause stating only 4 services in the 5 year time span of this contract. I was sms's yesterday to advise me that my contract would expire on the 25.3.2016 / 60 000km which ever comes first, so I cannot understand the refusal to authorize my service last week.

As per the manufacturer your vehicle has a standard service interval which is every 15 000 km or 12 months whichever occurs first. The applicable service leeway's are 1 500 km or 30 days either side of the service parameter reached first, that being kilometres or time. Our records indicate:
15 000 km service - on 13/01/2012 at 7 941 km by Thorp Delta Plumstead
30 000 km service - on 22/01/2013 at 22 207 km by Thorp Delta Plumstead
45 000 km service - on 14/01/2014 at 34 319 km by Thorp Delta Plumstead
60 000 km service - on 22/01/2015 at 46 689 km by Thorp Delta Plumstead
The Policy wording refers: Page 6
Please Note: Where a customer is a low mileage user, and therefore only requires annual services, then only the total services relevant to the kilometer intervals required over the total kilometers covered by this contract will be covered.
The 60 000 km service has already been approved and paid for however, for the remainder of the contract any maintenance and mechanical repairs needed will still be entertained.
