UNACCEPTABLE SERICE

A few months back,I requested a copy of my contract from Motion Fitness Worcester(which i took over from a friend)because when I got to the gym in the half of the month I was told I still owe money,I was then told my gym fees were increased from R395 per month up to R440 per month. After the first month of increase my debt had worked up to R900(even if I had not used the gym) and that money I do not have in ONE month.Then it just kept increasing my debt each month even if I had asked continuously for proof that they were allowed to increase my fees. I argued with them requesting to see where I had signed to this agreement,I was told that it had been in the contract and they never told me about this rule.Then they had the audacity to tell me I need to pay R20 for a copy of my contract(which was never even offered to me )I was told to bring my bank statements to them which I ignored because they had not wrongly taken my money I was just not about to accept this un-notified increase. For the past 3 months I have not paid my contract as I do not have that kind of money,and seeing as they could not supply me with the contract where in I signed for the increase. So a week or so back I contacted them again requesting cancelation forms because I apparently already owe them more than R2000 and now they want to add ANOTHER R900 this month to my debt. I argued with them about this because they had refused me a copy of the contract when I had asked for it ,for the simple reason that I cannot afford the contract anymore and my fees were increased without prior notice. I have not ONCE been informed about any outstanding money I owe them,when I contacted them about cancelation forms I was only told that they do not handle Overhanded clients and reffered me to their attorneys very disrespectful not giving me any information. I also have not been asked if I wanted to continue my gym contract,which was supposed to expire after 1 year which would have been before July this year.(I took the contract over from someone who had been there for 4months maximum) NOT ONCE was I told that I am being overhanded , I do not know what to do now because I do not have R3000 to pay and now have to pay legal fees aswell,while having to pay for a house and family at the same time. This gym is unacceptable I have heard numerous complaints that they refuse to stop your contract,even if a person ,like myself,is struggling financially and cannot pay their fees which they decide to increase whenever they feel like it. As result of everything I had heard about the gym prior to my own complications,I had gone into panic and told them the reason I could not pay my fees were because I had been jobless(even while e-mailing from my work e-mail) Now they are trying to get me to pay all the un-rightfull debt at once.

Good Morning,

Please accept our apologies for the frustration and upset that this situation may have caused.

The increase that you mention at the beginning, that is the annual escalation of the membership and it is covered in the terms and conditions.

If debit orders continue to be unsuccessful, the accumalative amount will increase by that amount until the membership fees are more than 3 months in arrears. Only once that happens do we hand it over to the attorneys. Please contact Michelle at *** and she will be able to make payment arrangements for you.
