Contract and Communication - Motion Fitness

In March 2015 I and my late wife decided to help our son with 24 month contract with Motion Fitness, so that he could stay fit and healthy.

The contract was in my son’s name, but we, as parents have pay the monthly fee of R367.00, because he did not have a work or an income at that stage.

For that 24 month period, there was no problem, because Motion Fitness received their monthly fee. In 2016 my wife have pass away, a few months before the end of this contract and I told my son, because he did not ever use the gym, maybe I going to take over the contract. But when I find out at Motion Fitness the possibility to take over this contract, they told me, sure keep the contract in my son’s name and use his Club card, I decided against it, because I do not like that suggestion.

I still have paid the monthly fee till the end of the contract in June 2017. On 24 of March 2017, I email and deliver a letter personally to Motion Fitness, to confirm that the contract must be cancelled when it expire has at June 2017.

Now here the problems start. We have absolute not receive any communications, like a letter, an email or phone call from Motion Fitness, Worcester. Because of that we were not aware of any problems.

I have stopped the monthly payments at the end of June 2017, when the contract has ended. Now after all that time, my son decided it is time to go get a new contract, because he is now ready to use a gym now. Last Friday he go to Motion Fitness and be told, no way he can be a member of Motion Fitness, because the old contract has not been cancel and he owns them R11,000.00.

He contact me about it and I was shocked that after nearly 24 months there are a problem and there was no communication from the branch or head office or their attorneys about it to my son or me and told him, I will help to sort this out. So, I contact Motion Fitness for more details. They told me that they did not keep any details at their branch, because everything they received must send to their head office, but she thinks that the head office would also not have any details because would be handed to their attorneys, for legal action.

Next I ask them to email the details of their head office and their attorneys, with no success, They will gave me the info over the telephone and because of this serious issue I want the details on writing, not verbally. Still that info is outstanding.

Please accept our apologies for the frustration that this situation has clearly caused, also please accept our condolences on the loss of your wife, I am sure it was a difficult time for all in your family, especially for you and your children.

Please mail me all your details, to *** so that I can look into this. What I would like to do is to cancel the old membership and zero base your outstanding amounts. Once we have done that, we can re-join your son on a membership and then issue you with a 3 months free membership, perhaps it would be great to spend some time with your son at the club, if you want to continue after that, then we will arrange to upgrade the single membership of your sons to a family membership.
