MWP not good enough

These Conveyancing attorneys are not willing to assist purchasing buyers with an electrical dispute.

We purchased a property from Eskom which transferred on 19th April 2018. The COC's were 'completed' as per our conveyancing attorneys and bond attorneys and we happily moved in on 20th April 2018. On the 8th May we experienced an electrical failure at the premises, at this point we contacted the conveyancing attorneys to request our electrical certificate which had not been passed on to us yet. (It seems you have to ask these days). We contacted the electrician who confirmed that he had done the electrical inspection on 1st June 2017, almost a year before, he stated that he was not responsible since the Owner had rented the property out to tenants prior to transfer. We as the new buyers would not have accepted this certificate, yet the banks and attorneys who are meant to ensure these are valid have accepted it.

We found out that the Plumbing and Beetle inspection were done prior to transfer but the Electrical Certificate was almost a year old.

We contacted the Seller after chatting to our conveyancing attorneys who politely said its not their problem, Eskom the seller, confirmed that the Certificate was valid, these are valid for 2 yrs... question being are these still valid if tenants have occupied the premises. They have refused to pay for the electrical repairs at the premises. We contacted Standard bank who are facilitating the bond and are currently the owners of the property until we pay them... they refused to assist us with this predicament and have referred us to the seller.

Let me warn other buyers when dealing with this legal practice who should be more diligent when reviewing documents and will not help you afterwards.

We went to the CPA who have confirmed via email that this issue between Eskom and ourselves the buyer in not their jurisdiction ... "Please note that this matter is out of our office jurisdiction." What a useless department, effectively scared to hold another department accountable.

The conveyancing attorneys cannot force their client to assist us but it seems they were willing to accept a COC for the electrical's which seems invalid with tenants occupying the property after its completion. Please be careful when dealing with this legal practice
