Failure to remedy latent defects in new apartment

Within a few months of completion of a residential block in Claremont known as Taranga, water ingress became apparent in the master bedroom of our newly built unit causing damage to the ceiling and walls. The original contractor had attempted to repair the full bore outlet on the balcony above, however, this has proven to be a futile exercise.

Since then the issues have worsened to the point that walls have cracked, ceilings are damaged and the apartment cannot be sold or let in its current state. The complication now is that Tristar Construction (the original contractor) has gone into business rescue and has stopped all remedial work on the building.

Our contractual agreement has nothing to do with the contractor and exists purely between us and the developer. Prospective buyers and the public should be warned of Monarc Property developers unwillingness to remedy latent defects in their own developments. Multiple emails, phone calls and requests have been ignored. We now have no choice but to resort to legal action or extensive repairs at our own cost.

Hello cobuscvw,

Good afternoon, we are a little residential letting agency in Benoni SA, we have nothing whatsoever to do with this residential block in Claremont known as Taranga. I think you have selected the wrong company to lodge this complaint against. Please rectify as a matter of urgency.
