Recover money from Company for vehicle damage

On 10th July 2024 at 14:25, Iwas driving in accordance with all traffic regulations when I was involved in an accident.

After collecting my son from school on the 10th July 2024, on my way back to the office, I was driving on West Lake Road, towards Main Reef Road, when all of sudden, a waste truck on Main Reef Road (Coming from direction Dobsonville, towards Robertville /Johannesburg), had to give way to the car in front of him (as he claimed that his brakes failed) and to avoid hitting that car from the back, he went into the left turning lane toward the traffic department, but could not make the turn and came right across the centre pavement into oncoming traffic (my lane). When I saw the truck heading straight for me, I drove on the pavement to avoid him hitting me and he also tried to avoid driving into me, so he hit a sharp turnout and dumped his waste that was inside his truck on my car, causing damages to the car. The person responsible for the accident contacted his owner and he contacted me confirming that they will sort my vehicle through their insurance(third party claim).

Up till today 11-11-2024 They haven't paid me out and had to fix my car through my insurance. They have promised me to pay me out. I even tried to negotiate but to no avail.
