Wrong choice of insurance

Miway continue to take advantage of my disadvantaged poor uncle, after one of their active policy holder failed to stop at a stop sign and bumped into my uncle's opel Corsa 2005 model bakkie .The accident that almost claimed his family's lives.After the assessments they promised to pay for the damages to my uncle but when it was time to do so they then changed and said that there won't be any payments due to him as Miway claims that my uncle was 20% wrong and their client was 80% wrong or rather contributed 80% to the accident. Now we have to take Miway's client to court over something that Miway could have settled as their client was paying them premiums every month. Miway is not a good choice of insurance
