Worst Insurer
My insurer MiWay has rejected my claim unfairly.
I have provided them with the necessary info they needed. I did admit to them that fatigue had a huge impact on the accident and that the weather was very bad and rainy. I did rest for a couple of hours before driving back to work as I was rushing to be on time from Port Elizabeth to Humansdorp. I disclosed with him should I be late I would be disciplined at work and be dismissed and couldn’t afford to be late on that day. The gentleman from the insurer was under the impression that I had consumed alcohol the day of the accident and asked me to send him my bank statements of that particular weekend. I clearly told him that I did drink a single drop of alcohol and I proceeded by sending my bank statements as requested. I acknowledge the speed was very high and it happened while I was falling asleep and the foot got hard on the pedal unnoticeable on my side. Upon the accident there were police officials who came to check up on me and advised me to go make a statement at the police station as they saw that I was in total shock but sober minded. My car was declared written off, the airbags were still intact and not deployed. I asked how can it be written off or what was the reasoning for it and I never received a straight answer for that . I submitted the statement and my insurer took more than a month to come back to me with a response and I felt very intimidated by the agent asking me repeatedly if I did not drink even after I told him I have not drank alcohol. The agent did get back to me with feedback regarding the incident and told me that my details were inconclusive and he had to have a meeting with the hierarchy. After a week I was told my claim has been rejected as a result of Due Care and Precaution. In the same week I get an email from the salvage yard that I should collect my vehicle which was unprepared for and I feel the insurer dragged the situation purposely so that they can **** me and pressure me to sell the vehicle for a lesser amount so that they can buy, fix and sell it. My question to them is how is fatigue driving a form of negligence, there was no form of alcohol in my system or found in the vehicle and how can it be written off without the airbags being deployed. I feel victimised by MiWay insurance and they dragged the claim outcome on purpose and it is unfair.
