Unsettled Claim by MiWay Insurance - Claim no C852021
MiWay Claim no C852021 (Sibanda /Magoai)
I was involved in a car accident on 20 May 2017. The person who hit my car was insured by MiWay. The Accident Report number is 249/05/2017. The driver who hit my car with car registration VTB 449 GP - Silver Gray BMW X3, was in the wrong and admitted to fixing my car. I was driving a Audi Silver Gray Q7 registration XFX 536 GP.
The insurance was in the name of the wife. After she called MiWay at the scene of the accident she confirmed that the insurance will fix the car and the car Q7 was towed together with their BMW by Precision Tow-In Service to Precision yard
MiWay insurance then requested me to submit quotations for repairs. I submitted quotations and the quotes stated that the car was a write off due to the airbags that popped. As of 23 October 2017, there was one quotation that quoted repairs to the value of R328 588.50 plus R 40 242 which was towing, admin, storage, security, etc. and that totaled to R368 830.50.
My car Audi Q7 4.2 TDi S-line, was paid up.
MiWay forwarded me forms for completion. I submitted all the documents that were sent to me by MiWay. At some point an offer of R44 000.00 (forty four thousand) was made by MiWay to me, I refused the offer as my car was not worth forty four thousand nor did it cost that amount to repair it. To date MiWay has been giving me the run around. I engaged UNISA Law Clinic and still there is no progress from MiWay. I am into my eighth year with this matter and this has taken its toll on me, leading me into a depressive mode.
Kindly advise how you can help me to resolve this matter
Thanking you in advance
