Unfairly treatment from MIWAY CAR INSURANCE

My brother was involved in an accident the car was damaged on the door, mirror and front bumper. The car is drivable with no damage on the engine, chasey even Airbags did not deploy. But the guy who was sent by the insurance to work the claim.decided to wright of the car or my brother must fix it himself.and if they Wright of the car he will be reliable to a short fall of 40k of which he doesn't have. And he was forced to make a decision on the spot on wheather he wants to fix it himself or he must pay the 40k short fall. So he chose to keep his of which I feel it's an unfair treatment from MIWAY INSURANCE. PLEASE HELP PEOPLE.
