UNFAIRLY REJECTION

On 12 of January my car was bumped by this other car that came direct to my lane and unfortunately I was unable to run away and this car was driven by a white man. This accident occurred at Armitage road in Pietermaritzburg. The accident was attended by the two police from Loop police station who came and discuss with the man that bumped my car and it looked like he told these police to arrest me without saying any word with me. It must be noted that immediately after the accident I found that this mam was not himself at all in the sense that I could see he was drunk. On 14 of January 2019 I submitted a car claim on Miway insurance for an accident that occurred on 12 of January 2019. Few days after submitting the claim, an investigating officer (Wayne) from Miway phoned to discuss the claim with me and at the end of the call we agreed that he would come to the scene to verify some of the details. Few days after the discussions with the investigator, I found out that the investigator is not going to come anymore and he did not provide me with any reason. A day after Miway sent me two emails informing me that my car is considered to be write off so I must forward the car keys and the settlement letter to the office of Miway or Miway will send the courier to pick up the car keys and the settlement letter, that was on the first email. On the second email Miway was informing me that someone has been appointed to do the recoveries from the other party that bumped my car and I will be paid my access money. Both of these emails fully suggested to me that the claim is successful. An hour after receiving these email, the investigating officer phoned to inform me that my claim is rejected based on suspicions that I was under intoxication when the accident occurred and he said he cannot discuss anything with me further when I wanted to find out more about the rejection. I formally disputed the rejection with no success, and I also found out from dispute report which was prepared by Mr Hlubi Melokuhle at Miway that the reasoning on the rejection were not true in that: Miway did not want to do the investigation to see that the other party was completely wrong and this could be confirmed on the photos that were taken on the scene and those photos were sent to Miway. Miway accepted police statements that were not even taken at the scene of the accident and were not even talking about the accident as the police left the scene with me and on those statements there were no sketches that Miway could be see how the accident occurred and I believe that would help on taking the decision. Miwya say on the report the other part say I came into his lane and it can not be like that if Miway was willing to assist me as a client. I am fully aware that Miway's intentions is to suck money from us by rejecting our claims without valid reason as one day I came across with a letter that from one of Miway managers instructing the employees that all black claims must be rejected by all means. It is very clear that the fact that my car was bumped by a white man also contaminated claim. I feel very disappointed about the way my claim was handled, I feel that its really true that Miway involve ****** when dealing with our claims.
