Unfair decisions made to third party accident claims!!!

I had an accident with one of the Miway clients. I had contacted them, and forwarded all requested documents and even verbally explained the situation to the agent Keneilwe Adams. after taking nearly 2 months, they finally came back telling me that I was 40% responsible for the accident, and giving me R1300 to fix a major smash on my car. This is so completely unfair when i did evasive maneuvers to avoid the accident and the facts of the accident is that the miway client swerved into me when i swerved away. Even the assessor that came to check the car was kind enough to hint he believed that it did not look like my fault at all.
