Unfair claim rejection by Miway
I have had the worst experience with Miway. I was involved in a car accident on the 4th August 2019. My accident included a car which left its lane to make an ******* turn onto my lane, as a result I bumped the car and my car suffered great damage. I then consulted Miway, they then conducted 2 telephonic interviews about the incident, and sent an investigator. I had to drive around with the investigator to the site of the accident where he took pictures and GPS coordinates of the scene site, he also requested I take him to all the places I drove to on the day prior to the accident. The investigator was very suggestive and consistent about asking me whether or not I had taken any alcohol on the day of the accident, and I told him countless times that I had not taken alcohol, my accident report also stated clearly that I was not under any influence. He was still not convinced of what was written on the report of the accident, and demanded that I give him numbers of all the people I drove with the day before the accident, he interviewed them individually and all these people say that he asked about alcohol intoxication.
On the same day, the assessor asked that I take him to the police station where I had reported the accident, he checked whether indeed the accident was reported ( he found that it was reported) and he then demanded to talk to the police officers who were handling the case of the accident_unfortubately the officers had already knocked off because it was after 15h30 when we got to the station.
The investigator called me again a couple of days later claiming that the police officers who were handling my case did not work at that police station that I had taken him to, I then told him that it cannot be the case that they didn't work there. (The police were driving a car which was branded the name of the police station on the morning of the accident ) He then added that the car was not a write off (this was before the car was assessed by the panel beaters where they took the car) however all the airbags had come out.
A couple of days later, still within less than a month, the investigator called me and said he is about to go present my claim to a panel of assessors, he then mentioned that I was driving at a high speed, I didn't deny the fact that I was driving at that speed but what he omitted from his report was that the third party was not supposed to make the turn he made because the lines on the road didn't allow for him to either overtake or turn ( I didn't loose control of my vehicle, the third party came into my lane to make an ******* turn, and did so without even indicating) , also what was ommited was that there are no signs from town up until where I got the accident that restricted me to a certain speed so I was not aware of the speed limit.
He called me after presenting my claim and told me that the claim was rejected and that I should go fetch my car from Ladysmith panel beaters, he also said I must pay the towing fees that had incurred.
I appealed the verdict using legalwise, and legalwise involved the ombudsman, after involving the above mentioned parties, we found out that the car was actually a write off ( this was after the panel beaters assessed both the obvious and hidden damages - about 4 to 5 months later). Till this day Miway has not come back to me with a fair answer, I have been suffering since August 2019 because of this issue, I was paying their high premiums monthly with no hesitations understanding that they are saying I'm young, unmarried, leading a stressful lifestyle ( I'm a medical doctor by profession) and im driving a fast car. I did this so that if it be that I happen to damage my car then they would be able to play a role as the insurer without hassles. Even after paying religiously, I am still left here with the frustration of an unfairly rejected claim and having to take public transport for traveling and running my errands. I paid paid premiums still whilest I was awaiting for a fair response from Miway.
It has been 8 months and my case hasn't been finalized. I know Miway has a history of ******, the CEO had to apologize on social media and had to deem the accusations untrue however, here I am experiencing it first hand. I now know for sure that Miway does reject claims based on race. For this I am willing to involve the media, to atleast warn naive colleagues who are coming in from medical schools into the field, and also any other newly graduated professionals to avoid by all means to be insured by Miway insurance.
