Things they don't tell you about TheirWay!

My husband and I, were involved in a car accident on the rainy evening of the 7th January 2017, by God's grace we suffered minor injuries. We submitted our claim to MiWay and they certainly lived up to their name of doing things TheirWay.

On the 27 January 2017 we were informed that we will enjoy NO COVER because, I quote their response: "During the validations of the claim it was discovered that you did not take reasonable care and precaution to prevent or minimise the loss." They had their accident reconstruction expert to do a report which was purely based on speculation since they never even contacted my husband who was the driver to show them what happened on the scene. They used random skid marks they found in the area a couple of days after our accident (a high accident zone, which had other accidents after our accident) and based their calculations on incorrect so called "evidence" which our expert has proved incorrect!

We submitted a complaint to their dispute resolution department and we were unsuccessful in resolving the matter. We had to consult with our own Accident Reconstruction Expert to reconstruct the scene using the facts provided and the evidence overlooked by the MiWay "expert". We then submitted our complaint to the office of the Ombudsman and they eventually advised that the matter needs to go to court as the matter had two conflicting expert reports.

We had to consult with an attorney and an advocate to handle the demands which have been sent to MiWay, which they have pleaded innocent and refuse to payout.

Mind you we are still paying off the debt of the vehicle 22 months after the rejected claim, we had to pay the Accident Reconstruction Expert upfront, (and they don't come cheap), still paying the attorney, advocate and sheriff of the court. And the bill keeps on growing since we are still going to court to fight the matter...
