Their way,not mine?.

Last year ( mid-march) i was involved in a car accident,where i had right of way and the other car didn't as it failed to stop @ the intersection (kitchner/buller rd,Cambridge),hitting my car and then breaking down a boundary wall of the cnr house( wonder what speed might they have been doing),it has taken a nearly a year for the insurance to correspond with regards to third party claims,after having submitted all the necessary documents..i got a email on Monday stating... " considering the circumstances and the information received, it is clear that both you and our client are to some degree negligent or to blame in causing the accident. The amount offered as compensation to you will therefore be adjusted.

It is our submission that you contributed 40% and our client 60% to causing/not preventing the incident. Our reasons for this are as follows, you:

- You failed to keep a proper lookout under the circumstances

- You had a clear unobstructed view of our client when our client proceeded from the stop sign.

You therefore will have to contribute 40% of the damage to our client’s vehicle, and in return our client will have to contribute 60% of the damage to your vehicle. The calculation is as follows:

Calculation Your Damages R 39 800.00 X 60% R 23 880.00

Our Market Value R225 300.00 Less Salvage R 93 993.00 Total R131 307.00 Plus Towing R 2 000.00 Total R133 307.00 X 40% R 53 322.80

R23 880.00 – R53 322.80 R- 29 442.80 (which i somehow owe)
