terrible service delivery

i would like to share my experience with dealing with my claim. Miway has decided to attach a salvage value of more than 88 % of my vehicles retail to my car. so i have only about a 10% value to repair my car.

any amount over that will make my car a write-off. as per Miway the salvage value is given to them by SMD . other insurance service providers to my knowledge work on about 70 % to write-off a vehicle. as per Miway my cars retail is R46 800 and salvage is R41 337 leaving me with just about R5400 to repair my vehicle. a salvage value is more than 88% of cars retail ,how is this possible? Miway claims manager tried explaining that SMD provides them with the salvage amount based on make/model and that can't be changed. how is it possibe that other insurers allow in the region of 70 % repair cost and Miway in this case only about less than 10 % ( R5400) to repair otherwise write-off if the cost is more than R5400.

the way i look at it is that if i claimed for sratches on my car and the scratch repair and respray is over R5400 then my car would be a wite-off. in this case its not scratches ,just making a point that the write-off process is totally wrong. R5400 is under 10 % of my cars value and my car needs to be written off because the repair amount is more than this. upon contacting SMD i was told that its not possibe for a salvage to be over 88% of the cars retail. all i need is for my car to be repaired. i do not want to be paid out the retail as Miway knows that my car sells for much more than retail as a private sale and Miway will profit from my loss. Miway says that "Kindly take note the purpose of insurance is to place you in the same position that you were in prior to the accident and not with the intention to enrich you. Therefore, MiWay would not settle more than the insured value, being the Retail Value for the incident vehicle at the time of the loss, less the applicable excess" please note that i did not request to be enriched by this claim. i just want my car to be how it was before the accident. the repair amount is no where near the norm of 70% as other insurers work on. i have received replies from Miway explaining how the salvage value is determined. It just doesn't make sense to attach a salvage value of over 88% of retail to a vehicle.

please contact me on ********** 362 to resolve my claim so that i do not have to go to the ombudsman.

Thanks for bringing this to our attention. We will look into this and get back to you with proper feedback.

Miway's method of settling my claim is to my disadvantage and I'm being put in a worse of position than being put in the same position prior to accident. Going the repair route will put me in the same position. Not the write-off route. idont see how I'm being enriched by just wanting my car to be repaired . I once again make it clear that I did not ask to be paid out more than my sum insured amount as was stated in the last reply from the disputes team

Miway your preffered repairer did not mention anything about discounts. the paint cost is R4,278.48.how rediculous is this. from how i look at it it seems that Miway and their preffered repairer work hand in hand just to inflate costs to write-off a vehicle. even if this is the case i still cant fathom out how my car can be written-off if the cost to repair is coming to over 10% of the car retail. just 10% approx. threshold to write -off is rediculous. i'm sure that the ombudsman will find my complaints interesting as miway provided me with incorrect retail values and salvage value from the begining.

here are some of my findings on Miway.
1. As per my most recent call to Miway last Friday I confirmed that my sum insured is in fact R55 900. Miway claims its not.
2. The transUnion valuation that Miway provided me is incorrect as I confirmed with another source on the very same TransUnion look up. I have sent Miway the screen shots of this.
3. The salvage value provided was somehow inflated to a drastically high amount ,almost more than 88% of my car retail. PS. This value was sent to me as two different amounts .
4. If MiWay has built an actuarial model based on more than 19,000 actual salvage cases, which predicts the salvage for a car based on the type of incident, damages of the car and other general car characteristics how do you not know the salvage value and provide different values each time I enquired.
5. You claim that your repairer that’s on your panel gave you a discounted quote but I got prices much less than your repairer for the very same replacement parts being the door mirror and r/f fender.
Ps. Your repairer also quoted those high amounts for alternate non-genuine replacement parts.
6. Your repairer states that my car has “Severity of Impact: Advanced Structural Repairs” , but only the fender and door mirror needs replacing. Nothing else needs replacing. How do your classify this as “Severity of Impact: Advanced Structural Repairs “ and how does this warrant a write-off.
7. The salvage value attached to my car is more than 88% of my cars retail therefore leaving you with a threshold amount of only R5400 for repair costs, therefore Miway claims that my car needs to be written off. ( ps. Only fender and door mirror to be replaced along with shocks which the repairer did not quote for. the rest of your repairers quote is for paint and labour to blend colour after repairing bumper and door. PS. Bumper paint only grazed off as in pic. Door needs repairing.
8. The threshold value that Miway is allowing me to repair my car is only about 10 % of my car retail, otherwise it’s a write-off. Other insurers work on a 70 % repair cost to write-off not only 10 % as in Miways case.
.
I have been inconvenienced for over 2 weeks now and I need my vehicle asap. I cannot be borrowing other family members vehicles and inconveniencing them as well.
As per point 1, my sum insured is R55900.00 and I was paying a premium for this amount. Now Miway tells me that my retail is R46 800.00 as per transUnion. But that too is incorrect as I double checked and the retail figure is infact much more than you say.( I have sent you the screen shots of the transUnion look up)

UPDATE FROM MIWAY. Miway gets back to me stating that they contacted SMD and now my salvage value is R40 000. The first response in writing to me said R34 360 as a salvage estimate that was provided by SMD as per Thandeka Makama. Thandeka Makama also stated that no matter the extent of damage to my vehicle ,my salvage value will be the same.( who else finds this hard to believe), then that estimate changed overnight to R41 337. Now Miway gets back to me stating that they contacted SMD and my salvage is R40 000. As per the transUnion dealers guide according to Miway my retail is R46 800 yet my vehicle is insured for R55 900 as i confirmed a few days back.
Miway wants to profit from my loss as thay know that a vehicle of my make and model sells for much more than retail. they have in no way tried to get my vehicle repaired after taking it to the repairer of their choice. Miway claims that they strive to put the customer back in the position he was in prior to the accident but they fail to keep to their promise because you have not repaired my vehicle and i have been without a vehicle for the 3rd week now.

frequetly asked question on Miway website
1. What happens if I was involved in an accident and the car was written off but my panel beater reckons that the car can be fixed?
response from Miway below
In the event of a total loss, you (the client) have the choice of making use of your own panel beater. If your own panel beater can repair the vehicle, the total repairs must be less than 65% of the insured value. The 65% of the insured value is not fixed, may vary based on vehicle type, make and model which will be determined by MiWay’s assessing department. We will further require that you (the insured), sign a disclaimer confirming that you elected for a repair on the vehicle at your own risk. Note: If the vehicle is financed we may require permission from the finance house in this regard.
Miway did not mention this to me at all in my claims process. why did they not say on their website that they use the vehicles salvage to work out the amount allowed for repairs. so from what i gather ,i should be allowed in the region of 65 % of my retail value to repair my vehicle as was stated by Miway. this can be verified on the frequently asked questions on Miways website. why was i not told about this before. and why am i being allowed about 10% only to repair my vehicle.
Miway please repond on this post and not hide your why your unfair practice of using high salvage values is not mentioned on your website. why was i not told anything about the 65% repair cost that you do allow. all you say is that you will get back to me with proper feedback ,but never do. i had to call in on several occasions to follow up on the progress of my claim.
