Sickening Service

To whom it may concern

I am writing this with utter disgust from the treatment I received from MiWay on my insurance claim due to an accident which occurred on the 5th of August 2016.

On the 5th of August 2016 I was involved in an accident on the corner of C.R Swart and Monument road in Kempton Park between the hours of 10 and 11pm. As I was driving on C.R Swart road I came across a curve where there was no sharp curve chevron sign and I hit a pavement resulting in the suspension of my vehicle being damaged.

After the incident I realized the car cannot move anymore due to the damage to the suspension. I then called a friend to come tow me home as I did not have the MiWay numbers at my disposal for them to assist with the towing. While waiting for my friend, an ambulance and few tow trucks came to assist. The paramedics asked if I am hurt and if they should do some checkups and I told them there is no need as I did not feel there was anything wrong with me. They tow truck guys came and offered me their services and I refused as I could not afford their prices for towing me back home. Eventually my friend came a few minutes after midnight to tow the car back home in Tembisa.

The following day (6th August) I then went to do an accident report at the Tembisa North Police Station. On Monday (8th of August) I reported the matter to MiWay and was given a claim number (C760676). On the 10th of August I received an email from claims validator Mr. Jean Aucamp that he wants to come assess the vehicle where I reside in Tembisa. He also required the following from me:

• Certified copy of your ID document and Driver’s License.

• Contact details of the person who helped you to tow your vehicle.

• Photos of the vehicle taken at the scene or after the accident to be emailed to me.

• Contact numbers of relevant witnesses.

• Details of all passengers (if applicable).

I sent him all the required documents and he told me that he would like to set up an appointment with me to discuss the activities of the day of the incident. We agreed to meet up at 6am on the 11th of August for him to come assess the vehicle in which he did and he took a couple of pictures of the vehicle. He asked me what am I gonna use to commute since my car is damaged and I showed him an Opel Corsa Utility which was parked in the garage and was once insured with MiWay for many years. We agreed to meet later on the same day at my office in Germiston where I perform my daily duties after Mr Aucamp goes to the place of the incident to check the terrace and surroundings of the area.

Mr Aucamp pitched at my office around 10 am and started with his investigation. He asked me about my activities after work and I told him I went home after work and played video games and decided to leave home around past 9 to head for Soweto. When I left home, I decided to pour petrol at one of the local gas stations and it was during the petroleum industry strike so I got there only to find there was no petrol at the local gas station. That is when I headed for Kempton Park and I poured petrol at the Engen Garage next to Birchleigh station. From there I proceeded to the C.R Swart road where the incident took place as I was going to join R21 by the airport and proceed to Soweto from there on. Mr Aucamp then called the person I was going to see in Soweto while I was in his presence and also called the guy who towed me while in his presence. Everything I told him about the day of the incident corresponded. He eventually said I must fill in a consent form for him to check my cell phone activity the day the incident took place. I comp**** and we both went to Germiston court to get it certified. That is then when he was done with his investigation with me.

On the 16th of August I was sent an email confirming my car to be a write off. I was told to send the following:

Original registration papers (if you have these), or a copy of the registration papers and a settlement letter from your finance house, if the vehicle is still financed. These can be sent to ********** />All keys for the vehicle (Including spare keys and remotes)
I sent the copy of the registration papers and a truck was sent to collect the vehicle from my place of residence.

On the 30th of August Mr. Aucamp gave me a call and told me that my cell phone service provider does not have activity of my cell phone on the 5th of August from 6pm to 12am. He then said he has a witness from the place where the incident took place that was not supposed to move from his designated post so that is why he did not come to help me during the incident. I then said to Mr. Aucamp I would like to know who the witness is and he refused me to meet him. I then told him that I do not have any other cell phone and I have people I called who will testify to having spoken to me with the very same number I use on a daily basis. I also said to him I do not know why my cell phone service provider cannot furnish him with my cell phone activity. Mr. Aucamp then said he does not want to discuss anything about the incident anymore and that he is rejecting my claim due to DISHONESTY.

This left me confused as I do not know when was I ever dishonest in this instance. I have been with MiWay for many years and never came across such treatment! I fail to understand why Mr. Aucamp did not reiterate on the fact that there was no Chevron road sign to show there was a curve and the fact that the Road Markings had faded, the Light at the place of incidence was not working as I had stated to him during his investigation. As far as I know the investigation was recorded but after he went to the place of the incident, he never gave me feedback on what I had told him.

He also said he went to one garage where I poured petrol and said there was no video footage. Since he did not want to discuss this any further, I wanted to ask him why go to one garage when you can go to both garages to check. I honestly cannot do Mr. Aucamp’s job for him, but I feel he insults people’s intelligence as opposed to his since he is a “Claims Validator”. His ways of investigating are appalling. I have never had a vehicle written off with MiWay and this is my first incident. I never thought an innocent accident would be twisted on me with factors that are beyond my control. I do not work for a cell phone service provider and I am yet to meet that witness who Mr. Aucamp took his words against mine.

I would like MiWay Disputes Department to look into my claim again as I feel I was done wrongly as a loyal paying customer.

Regards
