Recovery of Excess

Good Day I would like to lodge a complaint against MiWay

I was involved in an accident early this year on the 22nd of February. In this incident a towing truck hit me from behind at a traffic light, the towing truck company admitted fault and offered to pay for the damages on the vehicle. Being the good citizen that I am I chose to follow the instructions given by Miway stating that I shouldn't take any payments from the towing company.

I was then instructed to pay an Excess of 4500 as per my contract and they got my car fixed. I was however told that they would lodge a claim with the towing companies insurance company and refund me my excess as I was not at fault. 2 months passed, 3 months passed and then I called MiWay to find out on the status of the claim.

They then informed me that the towing company was registered with their sister insurance company and that it would be difficult to claim. This is so annoying because they keep mum, it is literally 10 months later and there's no progress in all of this.

So I get punished because the towing company is insured by MiWays sister company. How does that work, the towing company wins and I loose??????????????
