Premiums

I had tow policies with Miway insurance (Personal and Business) My business car got an accident after 29 months with them while it was driven by one of my drivers. The claim was approved after they have done their investigations with the following outcome . 1.Insured value= R184500 2. Insured vehicle accessories= R1975 3.Premium prejudice=37,48% which equates R69150,00 (The Insurer claims that I didn't disclose the regular driver and I was referred as the regular driver in the policy, which I don't agree since I once received a call from the insurer that was asking me if the vehicle was still parking at the given address, and as I didn't know the driver 's address I gave them the phone numbers of the driver to confirm every details they wanted to know and the driver also confirmed that he did receive the call and give the address, ID number , full names ,the route that he mostly work at and others . And now I can't prove that as all the recoding's I have to ask from them and they only sent me the once that suit them after four months . And the recordings and the call log doesn't correspond. And they used percentages to charge me not the extra excess as the policy says.) 4. Premium prejudice for mileage=6.08% which equates to R11217.6 (Insured had provided that the risk vehicle would travel 5*** km per month however it was found it travelled 8200km per month ( This is the reason they gave after I referred the matter to Osti (Ombudsman) but firstly they said that's because I refused to disclose the km of the car after the accident and this is because the asked me the km and I said they should call the driver to give them accurate km since I wasn't sure which they didn't and conclude by saying I refused to disclose the km of the car.) Excess=R5000 The settlement amount is ( 184500+1975=R186 475)-(69150+11217.6+5000+R85 367,60)=R101107.40

The car in November 2019 was still owing over R205 000 that means if I allowed them to settle the R101107.40 I would have the balance of over R100 000 which I found it unfair then I cancelled the claim and asked for the two policies 's premiums which they refused to pay then I involved the Otsi whom they didn't help also instead the say I'm not entitled to the premiums as I was covered during that period. And says "The insurer is still prepared to settle the claim on the above calculations"
