Poor claim service

I submitted a claim for the replacement of my windscreen that had been damaged.

The claim was approved per the Miway app. I then had a service provider My Glass contact me to do the replacement with a generic windscreen. They stated the insurer won't pay for the original glass because the car is out of warranty.

At the time of submitting the claim I stated the replacement should be original VW windscreen because that is what the car is currently fitted with. They refuse stating the ombudsman says they should use the generic glass. This is nonsensical, surely this is at the discretion of the insurer.

I am indifferent with this reasoning for the following reasons.

My car was insured with the original glass and I pay the premium on this basis with the same expected in the event of a claim. There is no "betterment" position created as its what is currently on the car. I have only ever used original parts on my car and serviced at VW dealership only. In my experience, the generic glass is not of the same quality, they chip, crack and scratch easily, resulting in further replacement in a short time. Your policy wording does not state in any way that can generic parts at the discretion of the insurer where vehicles are out of warranty must be used. This is the obvious expectation that the same OEM part will be replaced.

All I am expecting that the same original part be replaced as they are available from VW.

You "MiWay" talk a big game about transparency and great customer service, yet your ambiguous clause on indemnification fails to explicitly state your discretion includes the use of generic parts despite the insured vehicle having the original part at time of loss. One makes the very obvious assumption in this instance that it means any supplier can be used by Miway and not necessarily any generic part where an original part is lost and easily available.

You hide behind this documented article from the Ombudsman 2009 at claim stage! Why not state this explicitly in your policy wording from the onset when the policy is taken out! Yet, you throw this to the fore when a client complains about generic parts at claim stage only! All the time since 2009 you had this intent and didn't share upfront, Shame on you!


Wow, what fools we are, we buy a car with all original parts, insure is for that cost of original parts, service it with original parts and then let the insurer have their way and replace with all generic parts in the event of a loss. I wonder why the vehicle manufacturer service workshops don't these generic parts? Why they void the warranty if generic parts are used????!!!! FOOD FOR THOUGHT

The fact of the matter is,

YOU GET WHAT YOU PAY FOR

CHEAP PARTS = POOR QUALITY

CHEAP INSURANCE = POOR SERVICE
