Not happy

On the 27th June 2016 i crushed into a gate with my car, only the front left passenger door was damaged. I reported the matter to the nearest police station the same day and i was given an AR number then on the 28th June i lodged a claim on Mixpress and i received an automated email that i should forward photos of the damaged car of which i did, when i phoned the next day i was told the assessor was still busy with the photos, i decided to take my car to one of their approved repairers for physical assessment on the 1st July since i did not feel comfortable with the assessor relying only on the photos. On the 4th July i received an emailfrom Miway with an assessment report telling me that my car was declared a write-off and i also received a call from one of their represantative to arrange a collection of my car. On the report it says the settlement value is R33 150 and the cost to repair my car is R12 200. The report says 'This vehicle in question is however repairable, but the assessor and/or insurer has elected not to repair the vehicle as the repair costs, repair duration, availability of spare parts and the inconvenience to the client was taken into consideration'. What frustrated me is that the assessor only re**** on the photos that was sent by me, they could not even consider the physical assessment report from their approved repairer. Look i've been with Miyway for almost 7 yrs now and i have never skip even a single payment with them. On the policy documents that were sent to me, there is no where that says in the case my car is declared a write-off i would have no choice but to hand over the keys to them. I made few calls around to check how long can it take to repair this car, and i was told that it could take a week or two. What i want from Miway is to repair my car to put me in the condition my car was in before the accident as per their promise when i took the policy. And what i don't understand is, what informs the assessor's decision to declare my car a write-off since the cost to repair is far less than the value of the vehicle.

FYI: I checked around the prices of the same car as mine and i could not find one that is less than R45 000.

I feel my rights have been violated by the insurance that i trusted so much, now i believe when they say insurance companies get excited when they take your money every month but when you lodge a claim they don't care.

Hi,
Since Miway failed to do several quotes, i managed to get a lower quote from one of the approved repairers compared to the one their assessor used to make a report to write-off my car, but still Miway refused to repair my car, when i ask their assessor as to how much Miway covered my car for repairs, no clear answer was given to me. Mind you, my car is covered with Miway and am paying premiums every month. I have two cars and movable stuff insured with Miway and am currently searching for a better insurance company to move all my assets from Miway. I decided to to take this matter to my legal representatives, hopefully Miway will understand the language am trying to communicate with them.

Hi,
I got an email from Miway this morning telling me that since i have already lodged a claim with Ombudsman for short term insurance, i should refer any quiries to OSTI. To me it sounds like Miway is hidding behind door. Look i did my best wrt negotiating with Miway insurance to settle my claim, i even went as far as negotiating a discount with the panelbeater, it's very clear to me that they don't want to keep their promises which is to 'to put me in a condition that i was in before the accident' as indicated in their policy document. Mind you, the same insurance is still deducting premiums from my bank account even though they refuse to repair my car. The reason Miway does not want to settle my claim is because they want to use an estimation quote which is less by R683,74 compared to final quote. Look i have been insured with Miway for over 6 years now and i have never defaulted my monthly premiums with them.
Coming back to Olga who happens to be your claim advisor, i don't think it's fair enough to expect miracles from her as i believe she has superiors(Managers) from whom she takes instructions from, so i think it's time now to deal with one of her managers, maybe a clarity as to why Miway is refusing to use a final quote will be given to me cos i made it clear to Olga that a final quote will be forwarded.
