None payment of legitimate claim

I lodged a 3rd party claim with Miway as theit client had driven into me and he contributes towards 3rd party .The claim number being C***.

After having gone through the findings of Miways report its clear that the accident report furnished by myself and JMPD, wasn't taken into account ,and their findings were biased

The accident report states your client was turning left as per his statement , as he was going east which is the same direction i was headed , meaning he should've kept to the left lane as i was driving on the fast lane on the far right yet their client moved from the stop sign, speeded across the left lane straight into the right lane driving into me.

The left lane was clear and visible no obstructions forcing him into the right lane. why exactly did he head into the right lane bumping in to me In the last three paragraphs, Miway,alleges

"I Failed to brake or take any evasive action such as braking or swerving to prevent this collision"

Which in my statement to JMPD in the accident report and my narration of events in my claim to Miway, clearly states i swerved to the right to avoid their client, which landed me in the center of intersection when he bumped me.

Miway furthermore alleges " I Failed to keep a proper lookout of the road ahead as well as maintain an awareness of your immediate vicinity [Venter v ****son 1965 (4) SA 22 (E)]."

Claiming i failed to keep proper lookout of the road ahead, would be improper and misleading as i was looking ahead and almost out of the intersection when their client came speeding into me from the left side(blindspot) ,which means the was clear visibility of the road ahead on my left and right as i was driving ahead and therefore incorrect to say i didn't lookout.

Based on their allegations Miway claims they would impose the 70/30 rule implying I'm 30% liable for the accident which is incorrect and untrue. They have since ran their calculations at a negative claiming they paidout their client ,which shouldnt affect my claim as their client contributes to a 3rd party anf acknowledge he was at fault but refuse to pay for my car. Furthermore the Accident report in question had so many mistakes / discrepancies that were questionable that i raised with JMPD and the accident report was fixed, im surprised Miway anf their assessors didn't pick up on the errors yet claim to have done a thorough assessment when looking into my claim but missed all the mistakrd on that accident report which clearly shows it was never read or taken into consideration
