My motor vehicle accident claim was rejected by MiWay. Miway concluded that I left the Accident scene ********ly.

According to MiWheels policy wording “If I get involved in an accident and not injured but damage someone else's property, I am not allowed to leave the scene of the accident unless I have given my details to all the parties involved”. 1. I did everything a reasonable person would have done (I was at accident scene for approximately 30 min or more) 1.1. There is no time frame/Limit on how long I must be at the accident scene. 1.2. Just after the accident I tried to reach out to the third party to talk and exchange numbers and take the matter forward, but unfortunately the driver and his friends were aggressive towards me, threatening to beat me up and even going as far as promising to shoot me including the Man who claims that he was the driver of the third-party car. I was unfortunately not in a position to force the Third-Party driver to cooperate, as required by MiWheels Policy.

1.3. The third party and his brother came to apologies to me the next day at police station about the behaviour of the third party and begging me not to press any charges.

1.4. On the accident scene, my car-keys, cellphone were taken ********ly by the Third-Party driver and his friends, which is also an evidence of their aggression.

1.5. I stood just by the garage opposite at accident scene while my friends were trying to control the situation, only then I was able to call the Insurer (MiWay).

1.6. I phone Miway while I am at the accident scene explaining to them that, I got in to an accident and the third party is being aggressive and he is threatening me.

1.7. The Tow truck people came at accident scene and spoke to Miway using my phone. (I was present at accident scene)

1.8. Miway authorised the tow truck guys to tow my car whilst I was waiting at the accident scene using my phone while I was there. But now Miway claims a white lady authorised my car to be Towed, which I do not know how because Miway was speaking to me on the phone when they gave the tow truck authority.

1.9. Miway said I should not let the tow people to use a tow bakkie to tow my car, they can only use a flatback. (I was present at accident scene) 1.10. The tow truck people organized a flatback and we waited for it (I was present at accident scene) 1.11. The flatback arrived, I signed the forms to authorise the tow truck people to tow my car (I was present at accident scene) 1.12. Due to the nature of the situation and knowing that my vehicle tow truck was already arranged I decided to leave the situation to avoid any violence and rather report the issue when we had all calmed down. Indeed, by the time we went to the police station the third party had calmed down and handed over my keys at the police station.

1.13. No policeman chased me to town as MiWay mentioned, I gave MiWay permission to access my call records which I believe, and I know that the network towers will detect my location. That will help. When police arrived at the accident scene I was not there, but Miway claims that a police officer chased me, but the police officer confirms that I was not at the accident scene which confuses me how did he chased.

1.14. I am a law-abiding citizen, I will never engage in conduct which defeats or obstructs the course or administration of justice, I will never run or refuse when an officer of the law instructs me to do so.

1.15. I do not have an obligation to go to the police station immediately after the accident I have a time frame.

1.16. According to MiWay the witnesses they interviewed said what the third party was not threatening. I just want to put it out there that it is not for MiWay or the witnesses to judge on how I feel about certain behaviours in a situation that is not normal to me. The third said words like, Il beat you up, I’ll shoot you, he even pushed me. 2. Brooklyn is very unsafe, it is a very dark area with drugs, prostitution, and *******. It is not an area where one will feel safe. Hence, I told Carline one of the main reasons I invited my friends to come with was because I did not feel safe going to Garage alone at Brooklyn. There were no injuries to any parties involved in the accident and no pedestrians or passer-by injured due to the incident therefore according to my knowledge. Section 61 of the National Road Traffic Act 93 of 1996 (‘the Act’) requires a driver involved in an accident where a person or animal is killed or injured, or any property (including another vehicle) is damaged: • To immediately stop the vehicle. Which I did and as well arranged the approved towing of said vehicle through my insurer • To ascertain any injuries sustained to a third party and if there is an injured person, to render whatever assistance he or she is capable of rendering. No one was injured/seriously injured due to the accident. • To ascertain the nature and extent of any damage sustained Which was done to the best of my capabilities at the time. • Where reasonable grounds exist for a person to request the name, address, and further details of the insured, to provide such details. This information could not be obtained due to the hostility received from other party at the time. • If no report is lodged at the scene of the accident, to report the accident to the relevant police department within 24 hours of it having taken place (unless prevented by injury from doing so) and to produce his or her driver’s license and further details. This too was done within the prescribed time frame. • Except on the instructions or when administered by a medical practitioner, not to take any alcohol or drugs until the accident has been reported to the police and he or she has, where it is required by a traffic officer, been examined by a medical practitioner. In which I did not consume or take any alcohol/drug prior to the loss and after the said loss.
