MiWay the biggest ***** and fails to honour Contract

<p>This all started with my accident 3 weeks ago. I lodged a claim and the current value insured was 36000 for the vechile and 9000 for accessories. i loged a claim and after assesment it was told to me that due to teh cost of repair the vechile is a write off. So i inquired about the payout and was advised that it would be +36000 for car and +4000 for accessories and + 3000 for addtinalcover i took. I was also told that they would minus 3500 fro access. the payout would be +-27000. </p> <p> </p> <p>I then inquired as to what the buy back value of the vechile would be. I was shocked to hear and ammount of R22000. after inquiring the claims agent advised me that this is the amount that the assessor gives. i called up the assessor who then advised me that this amount is given to him before he even go out to see the vechile. so i asked him what was the current salvage value and he advised that it is 35 % of the current car value of 36000 which comes to an amount of R12600. so then i presented this information to the claims agent who disputed this and said that this is the amount SMd wants for the car. i then called smd and they advised that this is a lie and they only house and aution the car for Miway and they have an agreement for this car type to be auctioned at nothing less than 22000 when they receive the car and they will keep autioning it untill they receive that value to give to Miway. i then called the claims agent and provided her with my findings and asked them to give me the slavage value and not the standard sla that they have with SMD. After review they had agrreed that the amount shoud be in fact R12600. That means if i did not inquire i would have paid +-10000 extra for my vechile. At this point i inquired of the payount and it was confirmed again at +- 27000</p> <p> </p> <p>Then i was also informed that they reached that value as they are only paying 4000 for my accessories and yet they wer insured for a total of 9000. after inquiring the claims agent told me that the items have depreciated form 9000 to 4000. I only had the policy for two months. so iasked the lady if it depreciated to half the value in two months then in aprox 6 months the items would be worth nothing yet Miway will charge a premium. I then provided her would two letters from two team managers from Miway who at sale stage advised me in writing that in an event of a total loss they will pay the full value of the extras being 9000. after producing this evidence it was escalted to the team leader who told me that she will have to listen to sale call to see if i was told about depreciation on extras. This was despite me having two emails in writing whisch Miway will not honour</p> <p> </p> <p>After waiting a fewdays for feedback i receive a calls from the claims agent advised that they had now listned to to the call and infact the agent DID NOT mention depreciation, however, now the claims manager advised that because i am buying back the vechile they will not pay any amount for the accessories not even the 4000 as i am buying back the vechile, but if they keep the vechile then they will pay for the extras. To me this was a cheap excuse as now they had to pay me 9000 after listning to the call and realising that i was correct. I then asked to send me any wording or policy document that advise that if i am buying back the vechile they will not pay for extras. They could produce none OBVIOUSLY as this is not standard policy or it would have been mentioned from the begining and i would not have been given a payout amount of +-27000 more than 3 or 4 times. I disputed it and raised it with the claims manager who also refused to honour the email agreements i had in writing as well as my policy schedule whisch states extras for 9000. She advised that thhey will pay 9000 only if they keep the assets. so i said they can come pick up but the vechile cannot be driven so they need to make provision to take my damaged rims of the tyres and leave my tyres back. after much dileberation she agrred to pay the initial amount of 4000 for accessories still not honouring the 9000. i was now pressed for time and advised them to pay out. then i confirmed again with the claims agent what the payout amount will be and she again advised for like the 5th time and amount of 27000 and advised she will send me the form to sign as acceptance. then when i sign and send the form back she calls me the next day to tell me the payout amount is no longer +-27000 but they will now deduct a further 5000 for access as the policy is not more than three thee old. So after being promised +-27000 the only pay -+22000.
