Miway service regarding 3rd party claims

My wife was involved in an accident due to a driver who should not even possess a driver's license. He is insured with miway. They automatically feel that the 3rd party is at or partially at fault when there is an accident. They don't pay the 100% of 3rd party claims. You as a 3rd party should swerve and avoid the accident even if you have done so. Pathetic service when treating 3rd parties. You are expected to down an embankment just to avoid miway clients from driving into you, as a result the 3rd party is liable for 10% of their clients damages.
