MiWay Protects Themselves, Not Their Clients – Deeply Disappointed!

I am extremely disappointed and frustrated with how MiWay Insurance has handled my recent claim. I was involved in an accident on 15 March 2025 caused by a third party who admitted full responsibility at the scene, even submitting a signed affidavit confirming fault.

Despite this, MiWay refuses to process the claim under the third party’s liability cover. Instead, they expect me to claim under my own policy and for the third party to only pay the excess fee – which is completely unfair, especially when the vehicle has been written off. The car’s value is R248,000, and it was still being financed by Westbank, yet I’m left to carry the financial burden.

The reason? We are both insured by MiWay. I was told that if the third party was insured by a different company, liability would have been accepted. That is outrageous and *********. Now I’m being penalized simply because we share the same insurer? That’s not how liability cover is supposed to work, and there’s no clause in my policy that justifies this treatment.

I’ve been pushed from one consultant to another – Enrico Opperman, Phumeza Banzi, Moleboheng Ledwaba, and now Kgomotso Maraba – all while receiving zero updates. Even Westbank Motor’s representative has followed up with no success. Emails and calls are ignored, and they keep saying the case is being escalated. It’s now almost a month later, and no resolution.

Meanwhile, I am expected to continue paying for a car that no longer exists, and I’ve lost income from my Bolt business.

To MiWay and anyone reading this: we pay premiums for protection, not for excuses. This is *********, unreasonable, and emotionally exhausting. I wouldn’t recommend MiWay to anyone. If you're with MiWay – I urge you to review your cover. When you need them most, they’ll turn their back on you.

Claim number: C*** Third Party *** Accident Report: 76/03/2025 – Tembisa SAPS

I am now seeking legal support and urge MiWay to do the right thing before this escalates further.
