Miway is a death sentence

At the beginning of March 2021 I was involved in an accident with the Miway client, a claim was submitted and all relevant information as requested including two separate quotes from panel beaters.

This process was very jumpy as their staff were dragging their feet. Finally I was requested to submit pictures of the damages for an assessment (this is where the discrepancy started) I then questioned this process because as per my understanding you cannot access damages from pictures as opposed to doing a live assessment. I was then informed by a lady from their call Centre that it maybe due to covid19.

The damage amount on the the first quote was approximately around R56000 and second quote amounted to around R46000. After the assessment was done I was informed that the the settlement offer would amount to R17110. I was informed that I needed to swerve or do something to show that I tried avoiding the accident. In front of me was cars going opposite direction on my left was a field, the only way out was my breaks. In addition I didn't cause the accident, their client did. I did all I could at that time to avoid it.

According to the law The driver of a vehicle on a public road who desires to turn to the right shall, before reaching the point at which he or she intends to turn, indicate in the manner prescribed in these regulations, his or her intention to turn and shall not effect such turning unless he or she can do so without obstructing or endangering other traffic.

I would like to express my dissatisfaction regarding the outcome of this matter. I personally feel that the outcome was prematurely reached without a thorough research. As I have written in my statement I did all that was humanly possible to avoid the accident and I was not ever prepared to face oncoming traffic to give Miway a sweet satisfaction that I did something to avoid the accident.

I will from now on strongly criticize any of my friends or family members or members of the public to have a policy with my way based on the unsatisfactory outcome.

In addition I vow to make sure that I involve relevant people in this regard to make sure that the outcome is fair and just. I call upon assistance from people who are acquainted to such cases to come out and defend the just.

Your team keeps telling me that it's the obligation of both parties to avoid an accident, the question in regard is what is it that your customer did to avoid the accident?
I did something but I'm being punished for his wrong doing
