Miway Insurance Refusing To Settle Claim

I am a client of Miway. And my car caught fire; and below is what transpired and how Miway came to their decision to refuse to settle the claim:-

1. I was a plus/minus 2km away when the fire started [FACT - MAIN POINT] -collaborated by witnesses who were, just a few seconds, at the scene as the fire started. -even if Siphiwo found a bit of fuel [if Siphiwo can provide pictures] the engine indeed stalled/stopped as the car was standing on the side of the road with no driver [FACT] -I mentioned if I had come back [from fetching fuel] and the car still did not start, he would have investigated further 2. The entry on the bank statement: this could be any [other] car -At all garages, if a motorist fills fuel; if for example, the motorist says R20 and the pump goes over and reads R20.35; they NEVER, NEVER EVER make the motorist pay the 35 cents -In view of the above, it means the tank was actually topped up to FULL that is why the amount on the statement is R495.05. [FACT]. -Fuel for that amount is almost a full tank, if, for example, that car was empty. Which is contrary to Siphiwo’s almost half tank he says he found[FACT]. -I could not have driven nearly 500km [fuel was topped up late on the 6th i.e. the day before the incident] so that the fuel was at the level that Siphiwo claims he saw [COMMON SENSE] 3. The car had a tracking device, why did not Siphiwo use that to get the car's location to confirm which car I put fuel -Miway messed up my Ctrack account and could not get the report [only learned this last week i.e. July when Siphiwo phoned and I was questioning him]. The question is, Ctrack says the account is closed [according to Siphiwo] but the installment for that account is paid from the premium for the insurance, so where is that money [intended for Ctrack ] is going [Miway is busy putting together evidence of my “dishonesty”; and miss this point that needs further investigation] [this is a discussion for another day] 4. The car was an Uber [hence business insurance]; it used to make plus/minus R35K to R45K a month [FACT]; why would I burn a source of income like that 5. I joined Miway in 2016; if it were other insurance companies, I would have qualified to get all my premiums back. but here I am, being treated like a ******** 6. Mpho and Siphiwo are connecting the wrong dots; because they heard that it’s a quiet road; they alleged, that I had time, and I poured oil on the car and set it alight; totally disregarding the witness account. -The road hasn’t any passengers, but there are a lot of cars and runners/joggers/cyclists, do Mpho and Siphiwo honestly think other motorists would just ignore [and not inform the police] if they see someone pouring oil and setting a car on fire -Siphiwo says the fire expert found traces of oil on the car, a claim that the witnesses are refuting [affidavits and pictures can be provided by the witnesses who were SECONDS at the scene when the fire started]. If oil was poured on the car, the fire would start on the body; the witnesses can testify the fire started from under the bonnet. -The fire brigade, when they doused the car, the power of that water from the hose would have washed the oil off[ but Siphiwo claims he saw oil] -One of the witnesses, said he threw a fire extinguisher under the car to help put out the fire; the extinguisher had white foam-like/powder stuff, when it exploded, it showered and covered the most of the front part right up to the windscreen; we don’t know how Siphiwo was able to see oil -Siphiwo came to the conclusion that I set the car on fire because the passenger door was open [when he inspected the car for his assessment] -maybe it’s the crowd that had gathered at the scene that opened it trying to salvage any important stuff from the car. And also, the fire didn’t start from the ****pit/cabin [verify with witnesses]. There was commotion as there were a lot of people trying to help put out the fire before the fire brigade arrived [like I mentioned there was a lot of cars] -Mpho said, during my interrogation [his questioning is not assessment but "badgering"], my version of how I got back doesn’t tie with the witness [maybe Siphiwo never asked the witness how I got back to the scene - from fetching fuel]. Only later that day Mpho spoke with the witness, but still he chooses to ignore the witnesses’ version because he simply wanted to accuse me of dishonesty -Mpho, I answered some of your "badgering" questions with "questions' because I was questioning your line of thinking and reasoning. -So, if a client questions your logic, then he is dishonest; for instance, we spent almost 20 minutes arguing how I went back to the scene [from fetching fuel]. As I pointed out, does it matter how returned, the main point is a car caught fire, and how the fire started; and Mpho was quick pointing out how it didn’t collaborate with the witnesses account; which he hadn’t seen or heard as he only phone the witness later that day. And he still chose to ignore the witness’ testimony -Or badgering the client is a strategy so that you can claim dishonesty and then refuse to settle the claim -We have +5 [FACTS] points that show that I couldn’t have started the fire; and Miway judges me on one point [when we disagreed and I was trying to explain by questioning your logic - check with Siphiwo, I also questioned him when I saw that was how he is thinking. And also because I argued the relevance about how I went back to the scene].

Miway bases the refusal to settle the claim on that one point?

Miway actually cancelled my policy [and are not settling the claim]. They site dishonesty as the reason

Is, my car stalling and me fetching fuel, dishonesty
Is, me trying to point out how wrong they are in thinking the same car is the one that was filled with fuel the day before, also dishonesty
In addition to the above point there is another entry on the bank statement for fuel a few days after the incident; so which car was that; they assumed everything

Their deliberate lies about finding oil on the body is to suit their version [that i started the fire] so that they could refuse to settle and then cancel the policy
As part of repudiation process, i was give back the wreck, and we put a dip stick in the tank; the fuel was no less than a quarter; so that "half tank" they said they found was also a deliberate lie [to support their assumption of the car being filled with petrol the day before]

The fact that witness accounts put me about 2 km from the scene; why was there, still, [the] witch hunting [trying to pin the car that got fuel the day before as the car that caught fire]. That fact alone, if it was a fair, and professional assessment, the investigation/assessment would have ended there. But 90% of the conversation were me trying to explain and defend myself from allegation and questions that they must not have been asking at all [because i wasn't at the scene when the fire started]. They were not investigating/assessing at all; they were simply building their "dishonesty" case so that they can cancel the policy
